    ORDER:

    This writ petition is filed seeking the following substantive relief:-

    “to issue a writ of Mandamus declaring the A P Gazette Notification
    Supplement to Part-II No.6A dated 09.02.1989 issued by the 2nd
    Respondent insofar as the entries at Sl.Nos.2893 in including the
    lands of the petitioners admeasuring Acs.1-28 Gts in Sy.No.648,
    Ac.00-31 Gts in Sy.No. 659 and Acs.1-26 Gts in Sy.No.660 situated
    at Malkajgiri Village and Mandal Medchal-Malkajgiri District
    (erstwhile Ranga Reddy District) as arbitrary, illegal, unjust,
    without jurisdiction apart from being in gross violation of
    principles of natural justice and contrary to the provisions of the
    Wakf Act 1954 and Wakf Act 1995 and violative of the
    Fundamental and Constitutional Rights guaranteed under Articles
    14
    , 19, 21 and 300A of the Constitution of India and consequently,
    to set aside the said Gazette Notification insofar as the entries at Sl

    No 2893 is concerned and direct the respondents not to treat the
    aforesaid lands as Wakf lands and further direct the respondents
    not to interfere with the possession and enjoyment of the
    petitioners over the said lands in the interest of justice. ”

    2. Heard Sri B.Satish Kumar, learned Counsel appearing for the petitioners,

    Sri Farhan Azam Khan, learned Standing Counsel for Wakf Board and learned

    Assistant Government Pleader for Revenue.

    3. Learned Counsel appearing for the petitioners submitted that in similar

    facts and circumstances, a learned Single Judge of the erstwhile High Court of

    Andhra Pradesh, vide order dated 22.09.2016 in WP.No.33133/2014, set aside

    the Gazette Notification, dated 22.09.2016 holding that the survey conducted

    under Section 4(3) of the Wakf Act, 1957, is not saved under Section 112 of the

    Wakf Act 1995. He further submitted that aggrieved by the said order, the Wakf

    Board preferred appeal vide WA.No.1432 of 2016, wherein a Division Bench of

    this Court vide Judgment dated 04.12.2023 confirmed the order of learned

    Single Judge in WP.No.33133/2014 to the extent of setting aside the notification

    dated 15.11.2001 issued with regard to the subject property therein. However,

    the Division Bench set aside the findings recorded by the learned Single Judge

    that survey conducted under Section 4(3) of the Wakf Act, 1954 is not saved

    under Section 112 of the Wakf Act, 1995.

    4. Learned Counsel for the petitioners further submitted that the present writ

    petition may be disposed of in terms of the common order passed by the

    Division Bench of this Court in WA.No.1432 of 2016, WP.No.23242/2008 and

    WP.No.19205/2019 dated 04.12.2023.

    5. Learned Standing Counsel for Wakf Board did not dispute the aforesaid

    submissions of learned Counsel for the petitioners.

    6. Having regard to the submissions made by learned Counsel for the

    petitioners and learned standing Counsel for Wakf Board, the writ petition is

    disposed of in terms of common order dated 04.12.2023 passed in WA.No.1432

    of 2016, WP.Nos.23242/2008 and 19205/2019 and the Andhra Pradesh Gazette

    Notification Supplement to Part-II, No.6A dated.09.02.1989 at Serial No.2893,

    insofar as it pertains to the subject property is quashed. There shall be no order

    as to costs.

    7. Miscellaneous petitions pending, if any, shall stand closed.
