    2. Being aggrieved by the judgment and order dated

    17.07.2025 passed by the High Court of Himachal Pradesh

    at Shimla in Cr.MMO No.401 of 2025, by which the

    petition filed by the appellant herein under Section

    528 of the Bharatiya Nagarik Suraksha Sanhita, 2023

    (hereinafter referred to as ‘the BNSS’) seeking

    quashing of FIR No.0189/2023 dated 05.09.2023 filed

    under Section 376 of the Indian Penal Code, 1860

    (hereinafter referred to as ‘the IPC’) and Sections 4

    and 6 of the Protection of Children from Sexual

    Offences Act, 2012 (hereinafter referred to as ‘the

    Reason: POCSO Act’) registered with P.S. West Shimla, District

    Shimla, H.P. by which Sessions Trial filing No.5292/2023

    arose and the trial of the said case being at an

    advanced stage, were not quashed by the High Court, the

    appellant is before this Court.
