    Heard Sri Pawan Kumar S., learned counsel for the

    petitioner; Smt. M.M. Waheeda, learned High Court

    SPONSORED

    Government Pleader for respondent No.1; and Sri Sunil K.N.,

    learned counsel for respondent Nos.2 to 4.

    2. This petition is filed by accused No.2 in C.C.

    No.2204/2016. Respondent Nos.2 to 4 are the complainant and

    victims. The petitioner and respondent Nos.2 to 4 have jointly

    filed an application under Section 320 read with Section 482 of

    the Code of Criminal Procedure, 1993 seeking permission to

    compound the offences. The offences alleged are punishable

    under Sections 323, 354 and 504 read with Section 34 of the

    IPC.

    3. The application is accompanied by affidavits sworn to by

    the petitioner and respondent Nos.2 to 4. Along with the

    application, a joint memo dated 19.05.2026 has also been filed,

    duly signed by the petitioner, respondent Nos.2 to 4, and their

    respective learned counsel.

    4. The parties, who are present before the Court, jointly

    submit that they have amicably settled the dispute and that

    they have no objection for quashing the criminal proceedings

    which are the subject matter of the present petition. They have

    also jointly submitted, in response to the query made by the

    Court, that they have understood the contents of the

    application as well as the joint memo and are fully aware of the

    consequences thereof.

    5. The said submission is placed on record.

    6. The parties present before the Court are identified by

    their respective learned counsel, and they have affixed their

    signatures on the order sheet.

    7. Considering the submissions made by the learned counsel

    appearing for the parties, the statements made by the

    petitioner and respondent Nos.2 to 4, who are present before

    the Court, and upon perusal of the joint memo as well as the

    nature of the alleged offences, this Court finds no impediment

    to accept the joint memo and permit compounding of the

    offences.

    8. The joint memo reads as follows:

    “1. It is submitted that on the complaint of the
    respondent No.2, respondent No.1 police have
    registered a case in Cr.No. 100/2016 on 07/03/2026
    for the offences punishable under sections 323, 354,
    506 R/w 34 of IPC and thereafter the first respondent
    Police have filed a charge sheet against the petitioners
    for the offence punishable U/s 323, 354, 506 R/w 34 of
    IPC it was numbered as C.C.No.2204/2016 on the file
    of Hon’ble Prl. Civil Judge and JMFC at Nelamangala.

    2. It is submitted that at the intervention of the elders
    of both sides have reconciled all the differences
    between the parties and compromised the aforesaid
    disputes in order to bring the peace between the
    parties. Accordingly the petitioner and the Respondent
    No.2,3&4 and others have compromised their dispute
    in O.S.No.390/2018 on the file of I Addl. Senior Civil
    Judge & J.M.F.C., Nelamangala and they by settling all
    disputes relating to properties as well as the criminal
    cases, Pursuant to the said compromise, Original Suit
    No.390/2018 was disposed of by the Court of the I
    Additional Senior Civil Judge and JMFC at Nelamangala.
    Hence for the said reason, deserves to be quashed by
    the hands of this Hon’ble Court.

    3. In view of the settlement arrived at, the Respondent
    No.2, 3 & 4 (Victim No.1, 2 & 3) have no wish to
    continue the criminal proceedings initiated by them and
    they have no objection for quashing the proceedings
    against the petitioner. Since the alleged offences are
    punishable under section U/s sec 323, 354, 506 R/w 34
    of IPC which are non-compoundable, without
    permission of the court, this application is filed seeking
    permission to compound the above said offences.

    4. The petitioner and the Respondent No.2, 3 & 4
    (Victim No.1, 2 & 3) have understood the contents of

    this application and out of their free will, volition and
    without any fear, force, threat, or coercion, have
    affixed their signatures to this application.”

    9. In the light of the joint statement made by the petitioner

    and respondent Nos.2 to 4, and in view of the admitted joint

    memo dated 19.05.2026, this Court is inclined to accept the

    joint memo. Accordingly, the following:

    ORDER

    (i) The Criminal petition is allowed.

    (ii) The proceedings in C.C. No.2204/2016 arising out
    of Crime No.100/2016 for the offences punishable
    under Sections 323, 354 and 506 read with Section
    34
    of the IPC, pending on the file of the Principal
    Civil Judge and JMFC, Nelamangala, are hereby
    quashed.
