PRAYER:- Criminal Original Petition filed under Section 483 of the
Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 praying to enlarge the
petitioner / accused on bail in Spl.S.C.No.27 of 2025 in Crime No.200 of
2025 on the file of learned Special Judge at Karaikal.

ORDER
This Criminal Original Petition has been filed by the petitioner on

12.05.2026 under Section 483 of Bharatiya Nagarik Suraksha Sanhita
(BNSS), 2023, praying to grant bail.
2.The petitioner / A2, was arrested and remanded to judicial
custody on 16.07.2025 for the alleged offences punishable under Sections
20(b)(ii)(c), 24 of NDPS Act, 1985 and Section 14 A of Foreigners Act,
1946 and Section 3(3) of Passport Entry into India Act, 1920, in Special
S.C.No.27 of 2025 on the file of learned Special Judge, Karaikal, in
Crime No.200 of 2025.
3.The case of the prosecution is that on 15.07.2025 at about 22.15
hours, during routine vehicle check up, the petitioner, along with the
other accused, was found to be in joint and conscious possession of
26.095 kgs of dried ganja in a car bearing Registration No.TN-50-
BX-0006 at Packirisamy Pillai Street, V.O.C.Salai, Karaikal. On enquiry,
the said ganja was being transported for the purposes of illegal export to
Sri Lanka through sea routes and upon search at his residence, 277.949
kgs of dried ganja was recovered. Hence, the case.
4. The present petition is the second bail petition. While the earlier

petition, having been dismissed by this Court on considering the merits of
the case, now, Mr.P.Anbazhagan, learned counsel for the petitioner, apart
from apprising this Court of the merits of the case in reiteration, sought
for the indulgence of the Court to grant interim bail as of now on the
pathetic medical condition of the petitioner. He submitted that during the
incarceration, the petitioner had suffered numbness in the lower limb and
requires immediate medical care.
5. Mr.M.V.Ramachandra Murthy, learned Public Prosecutor
(Puducherry), who appeared before this Court through video
conferencing mode, having circulated a Status Report along with the
medical reports of the petitioner obtained from the jail authorities,
affirmed the contention of the learned counsel for the petitioner with
regard to the medical emergency of the petitioner.

7. Having heard the learned counsel for either side and perused the
materials and the medical report of the petitioner, this Court is of the view
that the petitioner can be granted interim bail for a limited period alone
on medical grounds, while making it clear that such consideration shall
not be taken as a precedent for other accused.
8.Accordingly, the petitioner is ordered to be released on interim
bail till 28.08.2026, subject to the following conditions:
(i)The petitioner shall execute a bond for Rs.10,000/- (Rupees
Ten Thousand only) along with two sureties each for a like sum of
Rs.10,000/- (Rupees Ten Thousand Only) to the satisfaction of
learned Special Judge, Karaikal, within seven (7) working days from
the date on which the order copy has made ready.
(ii)The sureties shall affix their photographs and left thumb
impression in the Application for Suretyship [Judicial Form No.46
annexed to ‘The Criminal Rules of Practice, 2019’]. The Special
Judge, Karaikal shall obtain a copy of any one of their identity proofs
to ensure their identity.
(iii) the petitioner / accused shall keep the Investigation Officer
updated / posted about his permanent as well as present place of
residence and mobile number. Any change thereof shall also be
immediately intimated to the Investigation Officer / Special Judge,
Karaikal.

(iv) During the bail period, the petitioner shall not leave the
State of Tamil Nadu and shall stay only in Puducherry or
Karaikal or Chennai. The petitioner shall intimate the
temporary address and mobile number to the respondent police
from time to time.
9.Post the matter on 28.08.2026.
