challenging the Order dated 22.08.2023 passed by the LXV
Additional City Civil and Sessions Judge, Bangalore City
(CCH-66) (‘trial Court’ for short) in O.S.No.4471/2021,
whereby the application filed by defendants No.9 to 11
under Order VII Rule 11(a) and (d) of the Code of Civil
Procedure, 1908 (‘CPC’) was allowed and the plaint was
rejected on the ground that it disclosed no cause of action
and was barred by limitation. Consequently, the claim of
defendants No.1 and 2 for share in the schedule properties
was also dismissed.
