The issue involved in these Writ Petitions and the Devaswom
Board Application pertains to the uses to which the Thekkinkadu Maidan/
Vadakkumnatha Kshethra Maidan may be put.
2. Brief facts necessary for the disposal of these matters are as
follows:

3. ThepetitionerSri.MadhuV.B.,statesthatheisadevoteeofSree
Thrisivaperur Vadakumnatha Temple. The temple is a very ancient temple
whichisrecognizedasaworldheritagestructurebyUNESCO. Accordingtothe
petitioner, this Court has issued various judgments and orders restricting the
use of Vadakkunatha Kshethra Maidan for public purposes. The petitioner
further contends that the respondents, Cochin Devaswom Board and its
officers, have flouted the orders by granting the Kshethra Maidan to political
and non-political organisations.

Courtfromtimetotime.ItiswiththeseassertionsthatthepetitionerinW.P.(C)
No. 24435 of 2025 seeks the following reliefs:
(1) o issue a writ of mandamus, orders ordirections,directing

therespondents1to4toforthwithstopgrantingpermissions
to conduct any programsinanyareaoftheVadakkumnatha
Shetra Maidan to anypoliticalandnon-politicalorganization,
business establishments or other entrepreneurs to perform
theirfunctionsinthesacredpremisesofShriVadakkumnatha
Shetra Maidan.
(2) o declare that the Vadakkumnatha Shetra Maidan can be

used only for the Temple related activities.

5. Thepetitioner,Sri.K.B.Sumod,statesthatheisadevoteeofSree
Vadakkumnatha Temple, Thrissur, which ismanagedbytheCochinDevaswom
Board (for the sake of brevity, ’the Board’). The petitioner contendsthatthe
official respondents, including the District Collector, City Police Commissioner,
the Cochin Devaswom Board and its officers, have intentionally violated the
directivesissuedbythisCourtandpermittedtheThekkinkaduKshethraMaidan
forusesotherthanthosepermittedbythisCourtinDBPNo.48of2010,WP(C)
No. 4617 of 2022 and WP(C) 26499 of 2018. The petitioner hasproduceda
copy of the common judgment in WP(C) No. 4617/2022 and WP(C) No.
26499/2018 dated 11.04.2023. According to the petitioner, the 1st

respondent, District Collector, is permitting the conduct of events in the
Thekkinkadu maidan without obtaining prior approval from this Court. The
petitioner has lodged various complaints before the 1st and2ndrespondents,
alleging that the official respondents have failed to strictly comply with the
orders of this Court.
6. ThepetitionerfurtherstatesthattheDistrictCollectorhasgranted
consent to organise a program ’Ente Keralam - Vipanana Mela’ (എന്റെ
കേരളം വിപണന മേള) on 12.05.2025 at the Thekkinkadu Maidan without
any authorisation fromthisCourt.Hehasproducedacopyoftheorderofthe
1st respondent dated 12.05.2025, marked as Ext.P4. The petitioner further
contendsthattheThekkinkadumaidanisalsousedfortheeventsconductedby
political parties. It is in thesaidbackdropthatthepetitionerapproachedthis
Court seeking the following reliefs:

12.04.2023, by the issue of a writ of mandamusorsuchotherwritor

adeclarationthattheBoardisnotrequiredtoobtainpermissionfromthisCourt
forlettingouttheMaidanotherthanforbeautification/constructionactivitiesas
ordered in Annexure A2 order.
8. Thekkinkadu Maidan is an open ground located in the centre of
Thrissur City. TheMaidansurroundsSreeVadakkumnathaTemple,oneofthe
mostsignificantSivaTemplesinKerala. ItisstatedintheDBAthattheMaidan
isacircularground,encircledbytheSwarajround,whichisthemainringroad
of Thrissur City. The petitioner has placed on record Annexure A1, a
topographic sketch showing the entire Maidan, including the Temple.
9. ItisfurtherstatedintheDBAthatSreeVadakkumnathaTempleis
situated in 9.5 Acres of property. The totalextentoftheMaidanis59Acres,
out of which the Temple is situated in 9.5 acres, which is demarcated by a
compound wall.
10. Sri. K. R. Sunil, the learned counsel for the petitioner in W.P.(C)
No.24435 of 2025, submitted that a direction may be issued from this Court
stoppingthegrantofpermissiontoconductanyprogramsintheMaidantoany
political and non-political organisations, business establishments, or other
entrepreneurstoperformtheirfunctionsinthesacredpremisesoftheMaidan.
The learned counsel would further submit that the Kshethra Maidan be
permitted to be used only for temple related activities.

11. Smt. Anupama Subramanian, the learned counsel for the
petitioner in W.P.(C) No.34749/2025 submitted that a direction maybeissued
totheCochinDevaswomBoardtoensurethestrictcomplianceofthecommon
judgment in W.P.(C)Nos.26649/2018and4617/2022dated11.04.2023andto
ensure that noprogramsoreventsaretobeconductedintheMaidanwithout
the prior permission from this Court. Profuse reliance was placed by the
learned counsel inA. A. Gopalakrishnan v. CochinDevaswom Board1
12. Sri. K. P. Sudheer, the learned Standing Counsel for the Cochin
Devaswom Board, would submit that this Court had issued various directives
from time to time with regard to the purposes for which the Maidan can be
used. Directions were also issued to seek permission of this Court for the
conduct of programs and events in the Maidan.
13. The learned counsel further submitted that the requirement of
obtaining prior permission of this Court for the conduct of events in the
Kshethra Maidan, even for activities related to the temple, is causing many
hardships to the Board and the said prerequisite would result in the loss of
revenuetotheBoard. Therefore,thelearnedStandingCounselseeksanorder
from this Court permitting the Board to more effectively utilise the Maidan
without any prior permissionfrom this Court.

14. The learned Standing Counsel has invited the attention of this
Court to numerous orders/judgments passed by this Court from 1990 onwards.
15. Annexure A2 order was passed by a Coordinate Bench of this
Court on 16.03.1990 while considering a petition submitted by Sri.
Vijayaraghava Menon. Paragraph 2 of the order reads as follows :
“ 2. While passing orders in the Petition, this Court on
22.02.1990interdictedtheBoardtodealinanymannerwithThekkinkadu
maidanandappurtenantpropertiesbywayofgrantoflicence,orleaseor
in any other manner. Even so, for the conduct of seasonal business
during ’pooram’ festival, this court granted permission intwoinstances:
one,foravendorofwater,melons,andtheother,toconductexhibitions.
Wereiteratethattheinterdictioncontainedintheorderdated22.2.1990
willstand. However,wemakeitclearthatthesaidordershallnotdeter
theCochinDevaswomBoardfromgrantingtemporarylicensesforproper
and adequate consideration, for conducting seasonal business during
’pooram’ festival or such other festivals and during the period of
exhibition. The temporary licences are for vendors and hawkers to
conduct business only. TheBoardshouldseethatnopersonerectsany
permanentorsemi-permanentstructureinthesaidThekkinkaduMaidan.
The petition is closed.”
16. On 28.03.2003, by Annexure A3 judgment, this Court permitted
the Board to use the Thekkinkad Maidan for the purposes mentioned in
AnnexureR2(a)inO.P.No.8521of2003. Inthatmatter,aCoordinateBenchof
this Court has considered the question whether the Maidancouldbeusedfor
religious purposes alone or not. The Bench, after considering the rival
submissions,heldthattheThekkinkadMaidancanbeputtoanyusewhichwill
not affect the sentiments of the Hindu community. Paragraphs4,5,and6of

Annexure A3 order are extracted hereunder for easy reference :
“ 4. In the order referred to above, we have stated that the
ThekkinkadMaithanamshouldnotbeusedforanynon-religiouspurposes.
The argument of the petitioners and the Devaswom Board was that the
term ”non-religious purposes” had to be changed as the Thekkinkad
Maithanam could not be put to any other uses except the religious
purposes. Accordingtothem,theCourtshouldgrantpermissiontousethe
Thekkinkad Maithanam for the uses catalogedbytheDevaswomBoardin
its statement, which are as follows :-
( 1) തൃ ശൂർ പൂരം എക്സിബിഷന്
(2) ഓ ണത്തിനോടനുബന്ധിച്ച് സിവിൽ സപ്ലൈ
കോർപ്പറേഷന് ഓണച്ചന്ത നടത്തുന്നതിന്
(3) ഓണത്തിനോടനുബന്ധിച്ച് കൈത്തറി വസ്ത്ര
പ്രദർശനവും വില്പനയും നടത്തുന്നതിന് തൃശൂർ
ജില്ലാ സഹകരണ ബാങ്കിന് നൽകി വരുന്നു.
(4) ഓണത്തിനോടനുബന്ധിച്ച് സഹകരണ
സംഘങ്ങളുടെ ആഭിമുഖ്യത്തിൽ പഴം, പച്ചക്കറി
കച്ചവടത്തിന്
(5) വിഷുവിന് സഹകരണ സംഘങ്ങളുടെ
ആഭിമുഖ്യത്തിൽ പടക്ക കച്ചവടത്തിന്
(6) ക്രിസ്തുമസിന്സിവിൽസപ്ലൈകോർപറേഷൻവക
ക്രിസ്തുമസ് ചന്തയ്ക്ക്
(7) വേനൽക്കാലത്ത് പരിമിതമായ തോതിൽ

വിവേകാനന്ദ സ്ക്വയർ എന്നിവയ്ക്ക് പൊതു
യോഗങ്ങൾക്കും റാലികൾക്കും, ധർണകൾക്കും

ccording to them, these uses cannot be said to be against the

beliefsoftheHindus. Further,itisstatedthatthemeeting,etc.arebeing
conducted far away from the Temple and it will in no way obstruct the
devotees from going to the Temple or obstruct any activity of the Temple.
.
5 On the other hand, Sri. Govindh K. Bharathan submitted
that premises of the Temple which is a sanctuary should not beusedfor
anysecularpurposes,butcanonlybeusedforreligiouspurposes. Weare
told that the entire Thekkinkad Maithanam will be about nearly80acres.
According to us, theThekkinkadMaithanamcanbeputtoanyuse,which
willnotaffectthesentimentsoftheHindureligion. Ofcourse,earlierthere
was an order preventing any semi-permanentorpermanentconstructions
there. After going through the list submitted by the Devaswom Board,
which is produced as Annexure R2(a), along with the statement, we are
satisfiedthatthesepurposesdonotinanywayaffectthesentimentsofthe
Hindus. But we want to make it clear that even if the meeting can be
conducted, no ”jatha” or anything like that can be conducted on the
premises.

6 After hearing the parties, weallowtheCochinDevaswom
Board to use the Thekkinkad Maithanam for the purposes which are
mentioned in Annexure R2(a). Annexure R2(a) will be appended as
Annexure to this order. Hence we allow C.M.P. No.1975 of 2003, C.M.P.
No.1977 of 2003, C.M.P. No.1808 of 2003 and O.P. No.8521 of 2003.”
17. In Annexure A4 order dated 08.06.2011 in DBP No.48 of 2010,
this Court has passed a detailedinterimorderwithregardtotheafforestation
activities in the Maidan and prohibiting construction activity by the Cochin
Devaswom Board in the Maidan without specific orders from this Court.
However, the prohibition was not applicable to temporary structures of the

Poorams and rituals. Relevant paragraphs of the interim order read thus :
“ 7. Inthelightoftheaboveandtakingintoconsiderationthe
report of the learned Ombudsman, itisdirectedthathenceforththere
shall be no construction, beautification or other activities in the
ThekkinkaduMaidanbytheGovernmentortheCorporationofThrissur
oranyotherauthoritywithoutobtainingspecificordersfromthisCourt.
TheCochinDevaswomBoardwillprotectthesaidMaidanappropriately
sinceitisthepropertyoftheCochinDevaswomBoard. Wealsodirect
that the District Collector will ensure that the directions in this order
regarding preservation of the Thekkinkadu Maidan is appropriately
supported by the District Administration. Insofar as the ’Jaladhara’
which has become defunct and has turned out to be the hub of
antisocial elements is concerned, the Secretary, Cochin Devaswom
Board is directed to ensure that thesameisdemolishedandremoved
within a period of one month from now without fail. Areportinthat
regardshallbeplacedonrecordwithinaperiodoffortyfivedaysfrom
today.
. In consonance of the above, we further direct the

Secretary of the Board to file an affidavit within a period offortyfive
days from today identifying the location in the Thekkinkadu Maidan
where afforestation activity can be taken up. Theviewsoftheforest
officials having jurisdiction over the area will also be specifically
obtained as regards the type of saplings and other aspects.
. Having regard to the factthattheThekkinkaduMaidanis

vested with the Cochin Devaswom Board, weareoftheviewthatthe
Government or the Corporation cannot independently decide on its
beautification and therefore we direct that allproposalsinthatregard
which have been taken up without the clearance of the Cochin
Devaswom Board will stand stayed until further orders. It is further
directed that there shall be no construction activity by the Cochin
DevaswomBoardintheThekkinkaduMaidanwithoutobtainingspecific
orders from this Court. This inhibition will not cover such temporary
structures which are necessary such as festival, Pooram andritualsin
connection therewith as is held hitherto, exhibition etc.
0. We are also told that there are no hoardings and

irect that the Secretary,CochinDevaswomBoardwillensurethatthe

entire Thekkinkadu Maidan is kept plastic free. The Secretary of the
Thrissur Corporation is also directed to ensure that the environment
safety levels are maintained in connection with plastic and
non-biodegradable and also biodegradable substances insofar as
Thekkinkadu Maidan is concerned, particularly because it is an area
which attracts the public.”
The aforesaid DBP was finally disposed of by this Court by order dated
08.07.2013. A copy of the orderwasproducedasAnnexureA5,wherebythe
interim order passed by this Court was made absolute.
18. The Cochin Devaswom Board has approached this Court and
preferredO.P.No.8521of2003andconnectedcasesseekingpermissiontouse
the Maidan for other purposes, which were not approved by this Court in
Annexure A3 judgment dated 28.03.2003. However, this Court has turned
down the request of the Cochin Devaswom Board vide Annexure A6 order
dated 30.09.2013 in DBP No.78 of2013. Paragraph6ofthesaidorderreads
as follows :
“ 6. Weareoftheviewthatifanyotherunrestrictedactivities
are permitted, it will have anadverseimpactonthepropertywhichis
one of the important locations as far astheentiretownisconcerned.
Therefore, the order passed by this Court inDBP48of2010willtake
care of all matters which may arise in future. We further clarifythat
whenever fresh applications or proposals are received from interested
parties, Devaswom Board will place the matter before this Court for
considerationandonlyaftersanctionbythisCourtanysuchactivitycan
be permitted.”
19. Later, based on the report oftheBoard,DBPNo.31of2022was

filed stating that due to the COVID-19 pandemic and other reasons, the
templesunderthemanagementoftheCochinDevaswomBoardwerefacingan
acute financial crisis and seeking permission of this Court to conduct an
exhibition/trade fair in the Thrissur Pooram Exhibition ground. The said DBP
wasdisposedofbythisCourtvideorderdated29.07.2022(AnnexureA8). The
Devaswom Bench of this Court, after a detailed consideration of the
submissions and the report of the learned Ombudsman, has disposed of the
petition with the following directions :
”29. Considering the fact that Cochin Devaswom Board is
facing acute financial crisis due to Covid-19 pandemic and other
reasons, which is not in serious dispute, we deem it appropriate to
grant permission to the Board to conductOnamexhibition/tradefair
in Thrissur Pooram exhibition ground in Thekkinkad Maidan, for the
current year, i.e., 2022, subject to the condition thattheconductof
exhibition/trade fair shall be confined to the exhibition ground in
ThekkinkadMaidanwherethereisnoafforestationactivitybyplanting
teak or such other trees.
9.1.Thereshallbenosemiorpermanentconstructioninthe

exhibition ground in connection with the Onam exhibition/trade fair.
Only temporary structures shall be erected in theexhibitionground,
asperthelayoutinAnnexureA8oftheproposedexhibitionstallsand
pavilionsproducedalongwiththememofiledbythelearnedStanding
Counsel for the Board dated 19.07.2022. The Board shall obtain
necessary licence/ permission/consent from the statutory authorities
fortheconductofOnamexhibition/tradefairintheexhibitionground.
The traders shall obtain necessary licence/permission/ consent from
the statutory authorities, for the respective stalls/pavilions. The
activities in connection with Onam exhibition/trade fair shall in no
manner affect the afforestation activity in Thekkinkad Maidan.
9.2. The Board shall conduct an auction of the right to

ccordance with law, and the layout of the stalls/pavilions shall be
a
published in its official website, along with other particulars. The
Boardshallpublishnoticesinvitingtendersinleadingdailies,inorder
to ensure wide publicity. In the said notice it shall be specifiedthat
thelayoutofthestalls/pavilionsandotherparticularsareavailablein
its official website. The Board shall also consider the feasibility of
conductinge-tender,givingoptiontothetraderstoquotetheamount
for individual stalls/pavilions.
9.3.TheBoardshallensurethatproperincomeisgenerated

by conducting auction of the right to conduct stalls/pavilions in the
Onam exhibition/trade fair. In such transactions, the Board and its
officials have to show due diligence in the manner of an ordinary
prudentmanofbusinesstoconducthisownaffairs,sincetheBoardis
essentiallyatrusteeofDevaswomlandwhichvestsinthedeity.Since
Thekkinkad Maidan is a Devaswom property no sale/trade of any
objectionablesubstancesshallbepermittedinOnamexhibition/trade
fair in the exhibition ground.
9.4. The terms and conditions andothermattersrelatingto

the conduct of Onam exhibition/trade fairshallbeplacedbeforethe
learned Ombudsman for approval. The expenditure incurred by the
Board in connection with the conduct of Onam exhibition/trade fair
and also the income generatedtherefrom,byauctioningtherightto
conductstalls/pavilions,shallbesubjectedtoauditbytheStateAudit
Department, immediately after the exhibition/trade fair is over.”
20. This Court has again intervened in the matter pertaining to the
Maidan by Annexure A9 judgment dated 11.04.2023intheWritPetitionsfiled
by Sri. K. B. Sumod, as W.P.(C) Nos.26499/2018 and 4617 of 2022. In that
judgment, this Court has issued various directives restricting the use of the
Maidan. The relevant paragraphs of the said judgment are as follows :
“ 49. In view of the lawlaiddownbythisCourtinSatheesh
[2022 (1) KLT 940] the roads constructed as per thespecifications

nd standards prescribed by the Indian Roads Congress are for

vehicular traffic, which cannot be converted as a parking space for
commercial orotherestablishments,religiousinstitutions,etc.,oreven
for putting up temporary structures in connection with festivals in
temples,churches,mosque,etc.,orforputtinguptemporarystructures
as resting place for headload workers, etc., or for putting up bus
shelters by political partiesor by any other organisations.
0.SincetheStateholdspublicroadsasatrusteeonbehalfof

the public, the inaction on the part of the State and the Local Self
Government Institutions in preventing such encroachments upon
footpathsorrightofwayofpublicroadswillamounttobreachoftrust.
Any failure on the part of the designated authorities, contractor,
consultant or concessionaire in maintaining the safety standards of
publicroadswillattractthepenalconsequencesprovidedunderSection
198A of the Motor Vehicles Act, 1988.

strict compliance of the law laid down by this Court in Satheesh
[2022(1)KLT940]inrespectofalltemplesunderitsmanagement,
by ensuring that no hoardings, advertisement boards, etc., or any
temporary structures are erected on the right of way or pedestrian
facilities of public roads around the premises of thetemplesunderits
management, in connection with annual festival and other religious
ceremonies.Theadditional6threspondentinW.P.(C)No.26499of2018,
i.e., the Secretary of Thrissur Municipal Corporation shallensurestrict
complianceofthelawlaiddownbythisCourtinSatheesh[2022(1)
KLT 940] by ensuring that no hoardings, advertisementboards,etc.,
or any temporary structures are erected on the right of way or
pedestrianfacilitiesofpublicroadswithintheareaofThrissurMunicipal
Corporation, forcing pedestrians including those with disabilities and
reduced mobility to walk in unsafe circumstances.”
21. While disposing of the Contempt Case No.2824 of 2023 filed by
Sri. K. A. Sumod, this Court observed in paragraph 6 of Annexure A10
judgment dated 25.07.2025 as follows :

“ 6.Duringthependencyofthiscontemptcase,anotherdevotee
of Lord Vadakkumnathan has filedW.P.(C)No.24435of2025seekinga
writ of mandamus commanding respondents 1 to 4 to stop granting
permissiontoconductanyprogramsinanyareaoftheVadakkumnatha
KshethraMaidantoanypoliticalandnonpoliticalorganisations,business
establishmentsorotherentrepreneurstoperformtheirfunctionsinthe
sacred premises of Sree Vadakkumnatha Kshethra Maidan and to
declarethattheVadakkumnathaKshethraMaidancanbeusedonlyfor
temple related activities. The said writ petition is pending
consideration.”
22. Sri. K. P. Sudheer, the learned Standing Counsel for the Cochin
DevaswomBoard,submittedthatinviewofthevariousdirectivesissuedbythis
Courtintheordersandjudgmentsreferredtoabove,theThekkinkaduMaidan
cannot be effectively used by the Cochin Devaswom Board. At present, the
BoardhastoobtainpriorpermissionfromthisCourtforlettingoutaportionof
the property for religious, cultural and commercial purposes. The procedural
delay in making applications to this Court and getting permission from this
Court would practically persuade the prospective lessees to opt for other
venues for conducting programs and events.
23. The learned Standing Counsel has pointed out that several
queriesandenquiriesarereceivedfromtheprospectivelesseeswhowouldlike
to conduct events in the Maidan. However, the Board officials are unable to
give a specific reply and to fix a date for the conduct of the events.
24. The learned Standing Counsel submittedthattheBoardisfacing

an acute financial crisis and is unable to manage all 409 temples under its
controleffectively. Thelearnedcounselhasurgedthatifadeclarationismade
totheeffectthatnopermissionneedbeobtainedfromthisCourtforlettingout
theMaidanforreligious,culturalorotherevents,itwouldbeagreatsolaceand
the Boardcantherebyaugmentitsincomebylettingoutsomeportionsofthe
Maidan to the prospective lessees.
25. The learned Standing Counsel further pointed out that the
exhibition ground is let out only for the Thrissur Pooram exhibition from
February to June. The income generated by the letting out of the exhibition
groundismeagre. Theexhibitiongroundiskeptunusedduringtherestofthe
year. The learnedcounselhaspointedoutthattheexhibitiongroundsituated
onthenorth-easternportionoftheMaidancouldbemoreeffectivelyutilisedby
letting it out for the conduct of some events from July to January.
26. ThelearnedStandingCounselhaspointedoutthatDBPNos. 9of
2023 and 72 of 2025 are pending before this Court with respect to the
restoration and conservation of Vadakkumnatha Temple and its premises and
the implementation of the master plan prepared by the Indian National Trust
forArtandCulturalHeritage(INTACH),whichincludesthebeautificationofthe
VadakkumnathaKshethraMaidan. AdetailedplanhasbeenpreparedbyIndian
National Trust for Art and Cultural Heritage (INTACH), a non-profit charitable

organisation registeredundertheSocietiesRegistrationAct,1860,foundedfor
pioneering the conservation and protection of India’s natural and cultural
heritage. By order dated 02.07.2026, this Court had granted permission to
proceedwiththemasterplan.ThelearnedStandingCounselsubmittedthatthe
additionalincomewhichmighthaveaccruedbylettingoutthevariousportions
of the Maidan may be utilised for the implementation of the masterplanand
the beautification of the Maidan/restoration and conservation of
Vadakkumnatha Temple and its premises.

27. Sri. K. R. Sunil, the learned counsel, has submitted that the
Kshethra Maidan could be permitted to be used only for religious activities,
exhibitions, and allied activities in terms of the directives issuedbythisCourt
from time to time. According to the learned counsel, the Cochin Devaswom
Board and its officials have flouted the orders of this Court by granting the
Kshethra Maidan to political and non-political organisations. Moreover, it is
pointed out that musical concerts, dances, etc., are being performed in the
Maidan, affecting the religious sentiments of the Hindu community. The
learnedcounselfurthersubmittedthattheGovernmentortheHeadsofvarious
departments have no authority to permit the Maidan for other purposes. In

of the Cochin Devaswom Board and without obtaining permission from this
Court.

28. Smt.AnupamaSubramanian,thelearnedcounsel,submittedthat
the District Collector, the 1st respondent in the said Writ Petition, hasflouted
the directions issued by this Court with regard to the use of the Kshethra
Maidan in the common judgment in W.P.(C) No.26499/2018 and W.P.(C)
No.4617/2022dated11.04.2023. Accordingtothelearnedcounsel,theCochin
Devaswom Board is duty-bound to ensure that no programs or events are
conducted in the Maidan without prior permission from this Court.
29. We have heard the submissions of Sri. K. R. Sunil, the learned
counsel for the petitioner in W.P.(C) No.24435/2025, Smt. Anupama
Subramanian, the learned counsel forthepetitionerinW.P.(C)No.34749/2025
and Sri. K. P. Sudheer, learned Standing Counsel for the Cochin Devaswom
Board.
Judicial Evaluation
30. Sree Vadakkumnatha Temple is situated in the heart of Thrissur
City. Annexure A17 is the topographic plan of the temple and the Maidan

surrounding it. The learned Standing Counsel has also placed on record
AnnexureA18,apendriveshowingthetopographicplan. Fromtherecordsand
thesubmissionsofthelearnedcounsels,wefindthatthetempleissituatedon
thetopofasmallhill. The’Nalambalam’and’Chuttambalam’ofthetempleare
located in an inner square, well demarcated by a compound wall on all four
sideshavingaheightofabout12feet. FourGopuramsarealsobuiltonallfour
sidesoftheinnersquare. Theextentoftheinnersquarewhereinthetemple,
the main deity, and the sub-deities are located is having an extent of 9.5 Acres.
31. The daily poojas and rituals of the said templeareconductedin
the innersquareofthetemple. However,duringthePooramfestival,whichis
organised during April - May and during Sivarathri and otherfestivalseasons,
the entire Kshethra Maidan is also used for various religious activities. The
outercircle,whichsurroundsthetemple,hasanextentof59Acres. Abovethe
outercircle,thereisanothercircle,whichiscalled’SwarajRound’,whichisone
of the most important roads in Thrissur City.
32. We have carefully considered the pleadings, materials placed on
record, and the submissions made in the court.
33. The crucial question involved in this case is whether the
Vadakkumnatha Kshethra Maidan can be put to any use other than religious
purposes and for the performance of the customary rites and rituals?

34. The learned Standing Counsel for the Cochin Devaswom Board
would submit that if the outer circle of the Kshethra Maidan is put to some
other uses, such as for the conduct of cultural events, sports events, and
politicalevents,theBoardmaybeabletoenhanceitsincometoagreatextent.
The additional income so generated could very well be used for the
development of the temple and the welfare of the devotees.
35. However, the learned counsels appearing for the writ petitioners
wouldsubmitthattheKshethraMaidancouldbepermittedtobeusedonlyfor
religious activities.
36. Wehavecarefullygonethroughtheordersandjudgmentspassed
by this Court from time to time.
37. ByAnnexureA2orderdated16.03.1990,thisCourtpermittedthe
CochinDevaswomBoardtograntatemporarylicenceorleasefortheconduct
of seasonal business like the sale of watermelons and to conduct exhibitions
during the Pooram festival.
38. As per Annexure A3 judgment dated 28.03.2003, this Court
permittedtheBoardtousetheMaidanforthepurposesmentionedinAnnexure
R2(a)inO.P.No.8521of2003. Inthatjudgment,thisCourtmadeitclearthat
the Maidan could be put to any use which will not affect the sentiments of
Hindudevotees. TheusesforwhichtheMaidancouldbeletoutareextracted

in the foregoing paragraphs of this judgment. As many as twelve purposes
were stated in Annexure R2(a).
39. InAnnexureA4andinAnnexureA5ordersinDBPNo.48of2010,
thisCourthasinterdictedpermanentconstructionintheMaidan. Furthermore,
this Court issued directions for the afforestation activities in the Maidan.
40. In Annexure A6 order dated 30.09.2013 in DBP No.78 of 2013,
thisCourtreiteratedthedirectivesissuedinDBPNo.48of2010. ThisCourthas
turned down the request of the Board to use the Maidan for purposes other
than those stated in the Annexure A3 judgment.
41. However, vide Annexure A8 order in DBP No.31 of 2022, a
Coordinate Bench of this Court permitted the Board to conduct
exhibitions/trade fairs in the Pooram Exhibition groundforthatparticularyear
to support the Board, which was facing an acute financial crisis during the
COVID-19 pandemic period.
42. By Annexure A9 judgment, this Court interdicted the installation
ofhoardings,advertisementboards,etc.,intheMaidanandalsotheerectionof
temporary structures so as to block the right of the pedestrians.
43. ThelearnedStandingCounselhasplacedonrecordtwoadditional
documents along with I.A. No.1/2026 as Annexures A19 and A20. Annexure
A19 is an office note of the Cochin Devaswom Board dated03.12.2025. The

44. Pursuant to Annexure A19 office note, the Board has issued an
order dated 28.02.2026, which is produced as Annexure A20. The relevant
portion of Annexure A20 reads thus :

45. The principal contention of the learned Standing Counselforthe
BoardisthattheKshethraMaidan,whichislocatedintheheartofThrissurCity,
could be more effectively used by letting it out temporarily for some
non-religious purposes so as to augment theincomeoftheBoard. According
tothelearnedcounsel,thereisnopointinkeepingthehugeextentofproperty
idle in an unproductive manner, particularly whentheBoardisfacingfinancial
constraints.
46. The learned counsels for the writ petitioners had expressed the
anxiety of the devotees that the commercialisationandtheuseoftheMaidan
for political and cultural activities would destroy its sanctity and purity.
47. Having considered the rival submissions,weareoftheviewthat
theCourthastostrikeabalancebetweentheconflictinginterestsoftheBoard

and the devotees. This Court cannot turn down or reject the reasonable
request of the Board to augment or increase their income, as the ultimate
beneficiaries are the deity and devotees themselves.
48. At the same time, this Court is conscious of the religious
sentiments, apprehensions, and anxieties of the devotees.
49. From thesubmissionsofthelearnedcounsels,itappearsthat,in
manycases,theimmovablepropertiesownedbythetemplesarekeptidleand
unutilised. No doubt, the landed properties and the buildings are one of the
major assetsofthetemplesunderthemanagementoftheDevaswomBoards.
Ifthewhole,oratleastapartoftheimmovablepropertiesareletoutforsome
events and programmes, the Board may generateoraugmentitsincometoa
great extent.
50. We have anxiously gone through Annexures A19 and A20
documents. In Annexure A19, Column No.1isthespecificlocationsidentified
distinctly, which could be used in a more productive manner. The entries in
Column No.2 are the uses permitted by this CourtbyAnnexureA3judgment.
The entries in Column No.3 are the new proposals submitted by the Board.
51. On going through the new proposal, we are of the considered
opinion that the temple ground shall not be permitted to be used by any
political party for their protests and gatherings. This Court in N PrakashV.

The Travancore Devaswom Board and others2, hadoccasiontoconsider
this issue. The relevant paragraphs of N Prakash (supra) are extracted
below :
“ 11. Before proceeding further, it would be useful to refer to
various provisions of theReligiousInstitutions(PreventionofMisuse)Act,
1988,ActNo.41of1988(hereinafterreferredtoas’theAct’).Theobjectof
the Act is to prevent the misuse of religious institutions for political and
other purposes.
2.
1 Section3oftheActstatesthatareligiousinstitutionorits
manager shall not use or allow the useofitspremisesforthepromotion
and propagation of any political activities. Section 3 of the Act reads thus:
”3.Prohibitionofuseofreligiousinstitutionsforcertain
purposes.–
No religious institution or manager thereof shall use or
allowtheuseofanypremisesbelongingto,orunderthecontrolof,
the institution–
(a) for the promotion or propagation of any political
activity; or
(b) for the harbouring of anypersonaccusedorconvicted
of an offence under any law for the time being in force; or
(c) for the storing of any arms or ammunition; or
(d)forkeepinganygoodsorarticlesincontraventionofany
law for the time being in force; or
(e) for erecting or putting up of any construction or
fortification, including basements, bunkers,towersorwallswithout
a valid licence or permission under any law for the time being in
force; or
(f) for the carrying on of any unlawful or subversive act
rohibited under any law for the time being in force or in

contravention of any order made by any court; or

13. Section 5 of the Act prohibits the use of funds of religious
institutionsforthebenefitofanypoliticalparty. Further,Section6ofthe
Actprohibitsthatareligiousinstitutionormanagerthereofshallnotallow
any ceremony, festival, congregation, procession etc. organised or held
underitsauspicestobeusedforanypoliticalactivity.Section7oftheAct
imposes penalties for the violation of Sections 3, 4, 5 and 6.
14. Section 2 of the Act defines the term ’political activity’, ’political
arty’ and ‘religious institution’.

“ (d)”politicalactivity”includesanyactivitypromotingorpropagatingthe
aims or objects of a political party or any cause, issue or question of a
political nature by organising meetings, demonstrations, processions,
collection or disbursement of funds, or by the issue of directions or
decrees, or by any othermeans,andincludesalsosuchactivitybyoron
behalf of a person seeking election as a candidate for any election to
Parliament, any State Legislature or any local authority;
(e) “political party” means an association or body of persons–
(i) which is, or is deemed to be, registered, with the Election
Commission of India as a political party under the Election Symbols
(Reservation and Allotment) Order, 1968, as in force for the time being; or
(ii)whichhassetupcandidatesforelectiontoanylegislature,but
is not registered, or deemed to be registered, as a political party,under
the Election Symbols (Reservation and Allotment) Order, 1968; or
(iii) organised to carry on any political activity or to acquire or
exercise political power through election or otherwise;
(f) ”religious institution” means an institution for the promotion of any
r eligionorpersuasion,andincludesanyplaceorpremisesusedasaplace
of public religious worship, by whatever name or designation known.“

15. InSinilkumarE.K.(supra),aBenchofthisCourtobservedthat
the temple is the focal point in the life of a community and often
represents its pride, identity and unity.

1 TherecannotbeanydoubtthatSection3oftheActprohibitsthe
use of the religious institutions or its premises for propagation and
promotion of political activities. Section 7 of the Act also provides the
penaltyfortheviolationofSections3,4,5,and6oftheAct.ThisCourtin
Hindu Seva Kendram (supra) and Sinilkumar E. K. (supra), made it
clearthatpoliticshasnoroletoplayintemples.ThisCourtreiteratedthe
same principleinMajorVellayaniDeviTempleAdvisoryCommittee
v. State of Kerala3 andJayakumar J. v. State of Kerala4.

Secretary, Thiruvananthapuram5, this court held that politics has no
roletoplayinTempleworship,andculturalorsocialactivitiesunconnected
withTempleworshiphavenoplaceinTemplefestivals. ThisCourtissued
directions to the Travancore Devaswom Board and its officials to take
necessary steps to ensure that no ’political activity’ as defined in Clause
(d) of Section 2 of the Religious Institutions (Prevention of Misuse) Act,
1988 takes place in any temple under the management of Travancore
Devaswom Board, in connection with any religious activities, festivals,
ceremonies etc., of temple, in contravention of the provisions of the Act.”
52. In view of the statutory provisions contained in the Religious
Institutions (Prevention of Misuse) Act, 1988 and the authoritative
pronouncement of the principles of law by this Court in N Prakash (supra),
Sinilkumar E. K. v. Travancore Devaswom Board6, Hindu Seva
Kendram v. State of Keralaandothers7,MajorVellayaniDeviTemple
Advisory Committee v. State of Kerala8 and Vishnu Sunil (Adv.),

Panthalam @ Vishnu Sunil v. Kadakkal Temple Advisory Committee
Represented by its Secretary, Thiruvananthapuram9, it is clear that
politics have no role to play in temples, the request of the Board to conduct
political activities in the Thekkinkadu Maidan of the temple is rejected.
53. AnnexureA19proposalwouldseekpermissionfortheconductof
all cultural events of all the departments and the parking of the vehicles in
connection with the programs.
54. Insofarasthisrequestisconcerned,weareofthefirmviewthat
theeventsandprogramsofalldepartmentsoftheStateGovernmentcannotbe
permitted in the Kshethra Maidan. The Board may grant permission to the
eventsrelatedtotheDevaswomDepartmentandtheprogramsofthetemples
under the control of various Devaswom Boards without accepting any licence
fee/rent. IftheMaidanisletouttotheprogrammes/eventsconductedbythe
other Departments, the Board may ensure sufficient licence fee/rentfromthe
other Departments. Permission was also sought by the Board to conduct
culturaleventsintheMaidan. Theterm’culturalprograms’istoowide,elastic
and capable of being interpreted in different ways. Insofarastheconductof
culturaleventsisconcerned,itisfortheBoardtotakeanappropriatedecision
to exercise the discretion vested with it in a prudentmanner,soastoensure
that the purity and sanctity of the temples are protected and the interestsof

the devotees are unaffected. On this issue, this Court cannot fix a
straightjacket formula as to which events should be permitted in the Maidan.
55. It is made clear that the remaining part of the proposal is
accepted by this Court, and the Board can give permissiontotheprospective
organisers with stringent conditions after ensuring fair returns in the form of
licencefee/rent. Itismadeclearthathenceforth,theBoardneednotapproach
this Court seeking permission for any of the programs or events as stated in
Annexures A19 and A20, other than those events to which permission is
declinedby this Court.
56. However, we reiterate that no permanent or semi-permanent
constructions shall be made in theKshethraMaidanwithoutprevioussanction
fromthisCourt. Soalso,noproposalforbeautificationbepermittedtobedone
without previous sanction from this Court.
57. We,furtherdirectthatthelicenceagreement/leaseagreementto
be executed between the Boardandtheprospectiveorganisersshallinteralia
contain the following conditions :
(i) strict prohibition on littering, waste accumulation, sale and
consumptionofnon-vegetarianfoodandthedisposalofanymaterial
within the temple premises;
(ii)mandatoryinstallationofadequatewastebinsandarrangements
for prompt waste removal;

(iii) measures to prevent water pollution, soil contamination, and
damage to vegetation or temple property;
(iv) stringent control of sound levels, ensuring that loudspeakers,
amplifiers, or musical instruments do not cause sound pollution or
disturb devotees or nearby residents, and that permissible decibel
limits are adhered to;
(v) prohibition on the use of plastics, flex boards, or any
non-biodegradable materials;
(vi) restrictions on cooking, storage of combustibles, or erection of
temporary structures except as permitted; and
(vii) the responsibility of the organisers to restore the area to its
original clean condition immediately after the event.
(viii) Total prohibition on erecting any permanent structures.
58. Afteracarefulconsiderationofthepleadings,materialsplaced
on record and the submissions advanced in the Court, we deem it
appropriate to dispose of these matters with the following directions :-
(1) DBANo.9of2025isdisposedofpermittingtheCochinDevaswom
Board to let out the Kshethra Maidan for the purposes statedin
Annexures-A18 and A19, subject to restrictions and limitations
imposed by this Court in the foregoing paragraphs.
(2) Subject to (1) above, no event or programme, whatsoever,shall
be held/conducted in the Kshethra Maidan without prior written

consent from the Cochin Devaswom Board.
(3) Itismadeclearthat,henceforth,theBoardneednotobtainprior
permissionfromthisCourtfortheeventsandprogramspermitted
by this Court in this judgment.
(4) Inviewoftheabovedirections,nofurtherordersarerequiredto
be passed in W.P.(C) Nos.24435 and 34749 of 2025.
