ORDER
1. Heard learned counsel for the parties.
2. The present petition has been filed by
the petitioner-wife seeking transfer of a
Divorce Petition No.1006 of 2024 titled as
“Panchal Ranjan Kunwarpal Singh Vs. Shivani”
pending before the Court of Principal Judge,
Family Court, Muzaffarnagar, District
Muzaffarnagar, Uttar Pradesh to the Court of
Principal Judge, Family Court, Vikas Nagar,
Dehradun, Uttarakhand.
3. During the pendency of the present
petition, with the consent of the parties, the
matter was referred to the Supreme Court
Mediation Centre for exploring the possibility

4. The parties have entered into a
settlement and the Settlement Agreement dated
12.05.2026 is on record.
5. In terms of the aforesaid settlement, a
joint application bearing I.A. No.159410 of
2026 seeking dissolution of marriage between
the parties by a decree of divorce on the basis
of mutual consent has been filed under Article
142 of the Constitution of India.
6. Under the settlement, the parties by
their own free will have decided not to live
together and to dissolve their marriage by a
decree of divorce subject to the respondent-
husband paying a sum of Rs.8,00,000/-(Rupees
eight lakhs only) to the petitioner-wife as
full and final settlement of all the claims
towards alimony, maintenance etc. in two
installments. Out of the said amount, a sum of
Rs.2,00,000/- (Rupees two lakhs only) was paid
by the respondent-husband to the petitioner-
wife at the time of signing of the agreement
and the balance sum of Rs.6,00,000/-(Rupees six
lakhs only) has been paid by way of a demand

draft bearing No.793090 dated 11.05.2026 in
favour of the petitioner-wife.
7. It has also been agreed that all civil and
criminal cases pending between the parties
shall stand closed, namely:
(i) Petition under Section 125 of the
Code of Criminal Procedure, 1973(bearing
Criminal Case No. 274 of 2023) dated
06.09.2023 before the Ld. Principal
Judge, Family Court, Vikas Nagar,
District Dehradun, Uttarakhand;
(ii) Complaint (bearing Complaint Case
No. 230 of 2025) under Section 12 of the
Protection of Women from Domestic
Violence Act, 2005 before the Ld.
Judicial Magistrate-First Class, Vikas
Nagar, District Dehradun, Uttarakhand;
(iii) FIR bearing No. 413 of 2023 dated
20.10.2023 filed at P.S. vikas Nagar,
Dehradun, Uttarakhand (now criminal case
No.230 of 2025 dated 16.04.2025 pending
before Ld. ACJM, Vikas Nagar, Dehradun,
Uttarakhand) State V. Panchal Rajan &
Ors. against the respondent and his
family members U/s 498-A, 504, 506 IPC;
(iv) Complaint Case bearing No.36439 under section 379 & 506 of IPC PS Kotwali before the Ld. CJM,
Muzaffarnagar, Uttar Pradesh and;

(v) Divorce Petition under section 13(1)
of the Hindu Marriage Act (bearing
Divorce Petition No. 1006 of 2024)
before the Ld. Principal Judge, Family
Court, Muzaffarnagar, Uttar Pradesh.
8. Considering the fact that the marriage
between the parties was solemnized on
30.04.2021 and since November, 2021 they are
living separately and it is contended that the
marriage has completely broken down, we
consider it proper to exercise our power under
Article 142 of the Constitution of India and
direct for drawing a decree of divorce by
mutual consent in the Divorce Petition No.1006
of 2024 titled as “Panchal Ranjan Kunwarpal
Singh Vs. Shivani” pending before the Court of
Principal Judge, Family Court, Muzaffarnagar,
District Muzaffarnagar, Uttar Pradesh which
shall stand closed accordingly.
9. Similarly, all other cases referred to
above shall also stand closed.
10. The parties shall remain bound by the
terms and conditions of the Settlement
Agreement.

11. The application being I.A. No.159410/2026
is allowed in the above terms and the transfer
petition stands disposed of accordingly.
12. The settlement agreement shall form part
of this order.
13. The Registry shall inform the respective
Courts about this order where the proceedings
are pending in the aforesaid cases.
14. We place on record our appreciation for
the sincere work done by the Supreme Court
Mediation Centre in facilitating the parties to
arrive at a settlement.
15. The instant transfer petition stands
disposed of.
16. Pending application(s), if any, shall
stand disposed of.
