01. It is very strange that the FIR which was registered at the instance of the
petitioner/complainant way back on 14.08.2021 bearing No. 136/2021
under Sections 420, 467, 468, 471 and 120-B IPC is still being investigated
by the Investigating Officer and the investigation till date has not been
completed. In spite of the fact that on the last date of hearing, the I.O Sub-
Inspector-Manjeet Singh was present along with the Case Diary file and the
Court in the peculiar facts and circumstances of the case granted time to the
learned counsel appearing on behalf of the respondents 1 to 4 & 8 to file
fresh status report with copy in advance to the learned counsel appearing
on behalf of the petitioner, which till date has not been complied with
02. The petitioner through the medium of instant petition seeking quashment of
the Final Award dated 09.04.1999 to the extent of the land measuring 14
marlas comprised in Khasra No. 654 min, Khewat No. 43 min and Khata

no. 277 min situated at Channi Himmat, Jammu which is the proprietary
land of the petitioner and the petitioner was deprived of his aforesaid land
by allegedly playing a big fraud by the then officers/officials of the J&K
Housing Board in connivance with respondents 5,6 & 7 and feeling
aggrieved of the same, the petitioner has also lodged FIR against the
accused. In addition, it has also been brought to the notice of this Court that
this Court in WP(C) No. 941/2022 is monitoring the progress of the said
FIR and also quashment of the order dated 09.08.1997 whereby plot carved
out of the petitioner’s aforesaid plot being Plot No. 332-?A/4 measuring
38′ x 35’+27’/2 i.e 1121 SFT situated in Sector 4 at Channi Himmat
Housing Colony, Jammu was allotted illegally/arbitrarily in favour of the
respondents 6; and also seeking quashment of order dated 10.03.1998
whereby the plot No. 332-B/4 measuring 31′ x 37’+32’/2 situated at
Channi Himmat Housing Colony, Jammu was allotted illegally/arbitrarily
in favour of respondent No.7 and also seeking quashment of the Lease
Deeds executed on 21.08.1997 and 24.03.1998.
03. The petitioner while filing the instant petition has based his claim on the
alleged fraud being played with the petitioner with active connivance of the
officials of the J&K Housing Board to facilitate the allotment in favour of
respondents 6 and 7 with sole object to defraud the petitioner from his
valuable land. Thus, an apprehension has been projected by the learned
counsel for the petitioner that the delay in investigation is being caused to
shield the officials/officers for obvious reason and this is the precise reason
that the FIR though registered at the instance of the petitioner way back on

14.08.2021 but till date the investigation has not been completed.
04. In the peculiar facts and circumstances of the case, this Court deems it
proper to direct the I.O to remain present on the next date of hearing along
with Case Diary file with view to apprise this Court the investigation being
carried as on date. In addition, the respondents shall also file a fresh status
report as already directed by this Court vide order dated 26.05.2026 by
explaining the delay as well in conducting the investigation as on date.
05. List this matter on 04.08.2026.
