3. The gist of the prosecution case is that on
30.09.2022 at around 10:30 p.m., accused persons
including the appellant herein had unlawfully
assembled and attacked Sunil Radhakisan Nalawade.
It is alleged that A-2 assaulted the deceased on
the head and face and when the witnesses attempted
to intervene, they threatened the appellant
alongwith A-1 and A-4 who were said to have arrived
later and demanded money while Sunil Radhakisan
Nalawade was being assaulted. On being shifted to
