Pursuant to the order dated 05.05.2026, the Secretary,
High Court Legal Services Committee has tendered two reports
dated 06.05.2026 in a sealed envelope. The envelope is opened.
2. From the said report, it appears that the petitioner No. 1
(accused) is today, about 23 years of age and the petitioner No.
2 (victim) is about 20 years of age and that they are living
together as husband and wife in the house belonging to the late
maternal grandmother of the petitioner No. 2 alongwith their
three children i.e., one daughter aged 4 years, a son aged 2.5
years and an infant aged about 5 months. From the report it
further appears that the petitioner No.1 and the petitioner No. 2

are not formally married and when they were about to get
married in the Church, the petitioner No. 1 was arrested and as
such, the same could not be solemnised. It appears that they are
planning to get married soon. From the report, it further appears
that the petitioner No. 2 is happily living with the petitioner No.
1 and she has no objection to the quashing of the FIR. It further
appears that the petitioner No. 2 has not received any
compensation/benefits from the Government either for herself
or the children and that she has an Aadhar Card and would be
applying Aadhar Card for her children. It further appears that
the petitioner No. 2 is interested in tailoring and would like to
pursue the course, if given an opportunity.
3. Today, the petitioner No. 1 (accused) and the petitioner
No. 3, who is the father of the survivor and the original
complainant (inadvertently, mentioned in the order dated
05.05.2026, as the mother of the survivor when infact, it is the
father who is the complainant) are present in the Court. When
questioned, the petitioner No. 3 states that his daughter i.e., the

petitioner No. 2 is happily residing with the petitioner No. 1 and
that they have three children. He states that he has no objection
to the quashing of the FIR qua the petitioner No. 1.
4. Considering that the parties i.e., the petitioner Nos. 1 and
2 intend to get married soon, this petition is deferred by a period
of eight weeks.
5. In the meantime, Mr K. Khan, learned AAG to submit a
report of the concerned Police Station as to whether what is
stated in the petition is true and correct i.e., that the petitioner
Nos. 1 and 2 are living together and have three children.
6. In the meantime, till the next date, all benefits as
applicable to the petitioner No. 2 and the three children i.e., the
Schemes from either the State or Central Government, which are
as under be extended to them;
(i) Scheme for Care and Support to Victims of under
Sections 4 and 6 of the POCSO Act (exclusively for POCSO
victims) [Nirbhaya Fund];
(ii) Mission Vatsalya Scheme (Child Protection Services);

(iii) Beti Bachao, Beti Padhao (BBBP) Scheme;
(iv) Meghalaya Victim Compensation Scheme, 2022;
(v) Meghalaya Health Insurance Scheme;
(vi) Ayushman Bharat-PM-JAY (free health);
(vii) Mission 1000 Days-Meghalaya;
(viii) Rashtriya Bal Swasthya Karyakram (RBSK);
(ix) Chief Minister’s Safe Motherhood Scheme or CM-SMS;
(x) Special Training Programme for age-appropriate
admission of Out of School Children (OoSC) and Back to
School Campaign;
(xi) Samagra Siksha (Back to School);
(xii) NALSA (Child-Friendly Legal Services for Children)
Scheme 2024;
(xiii) NALSA (Legal Services to Persons with Mental Illness
and Persons with intellectual Disabilities) Scheme, 2024;
and
(xiv) Mission Shakti-Women’s Safety, Support and
Empowerment; and
(xv) Insurance or any other scheme.
7. In order to enable the respondent No.2 to get the benefits
of the above said schemes, the District Child Protection Officer
(DCPO), Eastern West Khasi Hills District, Mairang as well as
the Secretary, DLSA, Eastern West Khasi Hills District, Mairang
are directed to ensure that the benefits as may be applicable to

the respondent No.2 and her three children are made available
to them at the earliest and in any event within eight weeks from
the date of receipt of this order. The respondent No. 2 also be
extended the benefit of any vocational course of her choice,
under any of the Schemes.
8. A compliance report of the benefits extended to the
respondent No.2 and her children be placed before this Court on
the next date.
9. The Registry to forward forthwith a copy of this order to
both, the Member Secretary, Meghalaya State Legal Services
Authority, Shillong and Commissioner and Secretary, Social
Welfare Department, Shillong as well as to the DCPO, Eastern
West Khasi Hills District, Mairang and the Secretary, DLSA,
Eastern West Khasi Hills District, Mairang to enable them to
take steps and comply with the same.

11. Interim relief granted earlier, to continue till the next date.
