Heard learned counsel for the appellants and learned
Spl.P.P for the State.
2. This appeal has been filed against an order, passed
by learned Special Judge (SC & ST Act), Munger in a case,
registered for the offence under Sections 341, 323, 376, 385 of
the Indian Penal Code, Section 67(A) of the I.T.Act and
Sections 3(1)(n), 3(1)(/k), 3(2), 3(V) of the SC/ST (POA) Act,
whereby the prayer for anticipatory bail of appellants has been
rejected.
3. From perusal of order impugned, it appears that

learned Court below has already taken cognizance against
appellants under Sections 341, 323, 376, 385 of the Indian Penal
Code, Section 67(A) of the I.T. Act and Sections 3(1)(r)(s),
3(w), 2(Va) of the SC/ST (POA) Act and as such, this appeal,
filed for grant of anticipatory bail to the appellants, is not
maintainable, in view of the decision of the Hon’ble Supreme
Court in the case of Bachu Das Vs State of Bihar and others,
reported in (2014) 3 S.C.C. 471.
4. In view of law laid down by the Hon’ble Supreme
Court in the case of Bachu Das (supra), the present appeal,
filed for grant of pre-arrest bail to appellants, is dismissed as not
maintainable.
