O R D E R
1. The submission on behalf of
the petitioner is that FIR No. 4 of
2022 at PS Gumanpura, District-Kota
City was lodged, against the
petitioner and 37 other co-accused,
alleging offences punishable under
sections 420 and 406 IPC. It was
alleged in the first information
report that accused had solicited
investments in their group of
companies, and have diverted the
funds, resulting in losses to the
investors. With similar allegations,
several other FIRs, details of which
are provided in paragraph 3 of the
writ petition filed before the High
Court, were lodged. In several of
those FIRs, the petitioner was
admitted to bail. However, as those

FIRs were multiplying, and were based
on identical allegations, writ
petition was filed before the High
court seeking clubbing of all FIRs
and joint investigation as they
related to the same offence. During
pendency of the said writ petition,
an application was submitted for
interim protection, which came to be
rejected by the impugned order.
2. It is the case of the
petitioner that similar petitions by
various accused were filed before the
High court, i.e. criminal writ
petition Nos. 575/2023, 882/2022,
303/2023, 576/2023 and 1132/2023,
wherein an interim order was passed
on 29.03.2023, and thereafter another
interim order was passed on
25.05.2023. It is the case of the
petitioner that those similar

petitions are still pending, and
therefore similar protection ought to
have been accorded to the petitioner.
3. Issue notice, returnable in
six weeks.
4. In the meantime, it is
provided that the petitioner shall
not be arrested in connection with
any such FIR which makes allegations
identical to the one in FIR No.4 of
2022, Gumanpura, District-Kota City.
5. It is, however, made clear
that the petitioner shall cooperate
in the investigation.
