01. The petitioner, through the medium of the present petition, alleges non-
compliance of the interim order dated 23.08.2023 passed in WP(C)
No.2195/2023 titled Mohammad Ismail Wagay vs. Union Territory of
J&K and Ladakh. The operative portion of the said order is reproduced
hereunder:
“Subject to objections from the other side and till next
date of hearing before the Bench, operation of impugned
notice bearing No.544-46/ROG dated 09.08.2023 issued by
respondent No.5 shall remain stayed.”
02. A compliance report has been filed by the respondents, wherein it is
stated that the matter was examined and it was noticed that eviction
notice bearing No.DFO/TNG/LB/2023-24/2192-99 dated 10.01.2024
had been issued inadvertently due to an oversight. It is further stated
that the matter is presently sub-judice in view of the earlier notice
issued by the Office of Range Officer, Gulmarg, which stands stayed by
this Court in WP(C) No.2159/2023.

03. In view of the compliance report filed by the respondents and the stand
taken therein, this Court is satisfied that the interim order dated
23.08.2023 has been complied with in its letter and spirit. Accordingly,
the contempt proceedings are closed.

Reply has been filed by respondent Nos. 4, 5 and 7.
Mr. Bikramdeep Singh, learned Deputy Advocate General, appearing
vice Mr. Hakim Aman Ali, learned Deputy Advocate General, seeks and is
granted four weeks’ time as a last and final opportunity to file reply, with
an advance copy to learned counsel for the other side.
