1. The instant criminal misc. petition has been preferred with
the following prayer:-
“It is therefore, most humbly prayed that this Hon’ble
Court may graciously be pleased to accept and allow
this petition and further be pleased to issue directions
for non-execution of the standing warrant dated
19.2.2021 so issued by the Special Judge, POCSO,
Sikar; and further be pleased to allow the
accused/petitioner to surrender before the trial court
after coming from foreign country.
Any other relief this Hon’ble Court deems proper may
also be passed along with costs in favour of the
petitioners.”
2. By way of filing the instant criminal misc. petition, the
petitioner is seeking directions to surrender before the Trial Court
after coming from foreign country.

3. It has been averred in the instant petition that warrants of
arrest under Section 37 of the Rajasthan Police Act have been
issued against the petitioner by the Court of Special Judge, POCSO
Act, Sikar. It has been averred in this petition that charge-sheet
under Section 299 Cr.P.C. has been submitted against the
petitioner before the Court of Special Judge, POCSO Act for the
offence under Sections 363, 354, 376/511 IPC and Sections 7/8 of
the POCSO Act. It has also been averred in the petition that
proceedings under Sections 82 & 83 Cr.P.C. have been initiated
against him. It has also been averred in the petition that the
petitioner is residing in a foreign country and there is an
apprehension of arrest at the airport, on the basis of look out
circular issued against him, hence, liberty has been sought to
surrender before the Trial Court, after returning from the foreign
country.
4. The relief sought for in the instant criminal misc. petition is
highly misconceived, as no such direction can be issued by this
Court.
5. Accordingly, the instant criminal misc. petition stands
dismissed. Stay application as well as all pending applications, if
any, also stand dismissed.
