    This Criminal Appeal is directed against the

    judgment of conviction and order of sentence dated

    05.02.2024 passed by the XXI Additional Chief

    Metropolitan Magistrate, Bengaluru, in C.C.

    No.37511/2021, convicting the appellant for the offence

    punishable under Section 138 of the Negotiable

    Instruments Act, 1881.

    2. The appellate jurisdiction of this Court is not

    confined merely to re-appreciation of evidence, but extends

    to examining whether the procedure adopted by the trial

    court conforms to constitutional mandates, whether the

    trial was fair, and whether the findings are the product of a

    legally sustainable process. A conviction which is

    procedurally flawed cannot be saved merely because it

    appears substantively plausible.
