The instant Criminal Appeal under Section 374(2) CrPC has been filed against judgment and order dated 07.07.2009 passed by the Additional Sessions Judge, F.T.C.-5, Lucknow, in Sessions Trial No.692 of 2003, State v. Manish Kumar Yadav and others, arising out of Case Crime No. 385 of 2001, under Sections 323, 504, 506 I.P.C. and 3(i)(x) S.C./S.T. Act, Police Station Ashiyana, District Lucknow, convicting and sentencing the appellants as under:-
(i) under Section 323 I.P.C. to one year rigorous imprisonment and a fine of Rs.1,000/- each and in default of fine, one month additional imprisonment.
