    [1]          Mr. M. Hemchandra, learned Sr. counsel assisted by
    
    

    Mr. Juno Rahaman, learned counsel appeared for the petitioner.

    [2] After arguing at length, the learned Sr. counsel

    submitted that he has received instructions to withdraw the

    present writ petition with the liberty to file a Statutory Appeal as

    provided under section 18 of the Scrutinization and

    Reconstruction of Financial Asset and Enforcement of Securities

    Interest Act, 2002 (SRFAES Act) and the rule made thereunder.

    [3] The learned Sr. counsel, however, submitted that as

    the Appellate Tribunal as mentioned in section 18 of the SRFAES

    Act is situated at Kolkata and as the petitioner has certain

    difficulty to arrange the financial requirement and logistical

    support in filing the said statutory appeal, the petitioner will not

    be in a position to present the said statutory appeal before the

    Appellate Tribunal within prescribed period of limitation.

    [4] The learned Sr. counsel accordingly, made a prayer

    before this Court to allow the petitioner to file statutory appeal

    before the Appellate Tribunal within a period of 20(twenty) days

    from today with an application for condoning the delay, if any, in

    filing the said appeal and to pass an order restraining the

    respondents from taking any coercive action against the petitioner

    till filing of the said statutory appeal within the aforesaid

    stipulated period of 20(twenty) days.

    [5] Taking into consideration the submission made by the

    learned Sr. counsel appearing for the petitioner, the present writ

    petition is hereby disposed as being withdrawn with liberty as

    sought for.

    [6] It is made clear that no coercive action should be

    taken against the present petitioner till filing of the said statutory

    appeal within aforesaid period of 20(twenty) days from today.

    [7] Connected application also stands disposed of.
