Heard the learned counsel for the petitioner and
learned Additional Public Prosecutor for the State.
2. The petitioner is apprehending his arrest in
connection with Kesariya P.S. Case No. 398 of 2025 registered
for the offences punishable under Sections 142, 341, 323, 325,
307, 379, 504, 503 & 149 of the Indian Penal Code & 189(2),
126(2), 115(2), 117(2), 109, 303(2), 352, 351(2), 190 Bharatiya
Nyaya Sanhita, 2023.
3. According to prosecution case, the informant,
Lalbabu Rai, alleged that on 18.07.2025 while returning from a
tea shop, he was surrounded by the accused persons armed with
lathi, danda, and an iron chakri. It is further alleged that Awadh
Rai assaulted him on the head and assaulted him which caused
multiple injuries and fractures. It is further alleged that at the
Patna High Court CR. MISC. No.19457 of 2026(2) dt.08-04-2026

hospital, the accused persons again assaulted him and his wife,
and snatched her gold chain. Later on police had arrested the
other two accused and lodged F.I.R.
4. Learned counsel for the petitioner submits that the
petitioner along with others is alleged to have assaulted the
informant. The case of the informant is that since he was a
witness in connection with Kesariya P.S. Case No. 30 of 2025
he was attacked by these persons. There is no specific allegation
of assault against the petitioner. One of the co-accused Awadh
Rai has already been allowed anticipatory bail vide Criminal
Miscellaneous No. 14736 of 2026.
5. Learned APP for the State opposes the prayer for
anticipatory bail application.
6. Considering the aforesaid facts and circumstances
of the case that there is no specific allegation against the
petitioner and he is having one criminal antecedent in which he
is on bail, this court is inclined to grant anticipatory bail to the
petitioner.
7. Let the petitioner, above named, in the event of
his/her arrest or surrender before the Court below within a
period of thirty days from the date of receipt of the order, be
released on bail on furnishing bail bond of Rs. 10,000/- (Ten

Thousand) with two sureties of the like amount each to the
satisfaction of the learned J.M.1st Class, East Champaran,
Motihari/concerned court in connection with Kesariya P.S. Case
No. 398 of 2025, subject to the conditions as laid down under
Section 438(2) of the Code of Criminal Procedure / Section
482(2) of the Bhartiya Nagarik Suraksha Sanhita.
