Learned counsel for the petitioner submits that an

SPONSORED

application under Order IX Rule 13 of CPC filed by the petitioner is

pending long consideration before learned Tribunal. It is,

therefore, prayed that a direction may be issued to learned

Tribunal to adjudicate the application under Order IX Rule 13 of

CPC at the earliest. In support of his contentions, learned counsel

for the petitioner has placed reliance upon a judgment rendered

by this High Court in Suman versus Manoj Kumar passed in

S.B. Civil Writ Petition No.3959/2012 decided on 01.05.2012.

Having considered the argument advanced by learned

counsel for the petitioner and taking into consideration the

judgment referred, learned Tribunal is directed to decide the

application preferred by the respondent under Order IX Rule 13 of

CPC within a period of three months from the date of this order.

Accordingly, instant civil writ petition stands disposed of in

above terms.

Stay application and all pending applications also stand

disposed of.
