Respondents
WHEREAS the Petitioner above named through his Advocate SRI
MIRUTHI SRINIVAS MUNIPALLE, pfesented this Petition under Article 226 of
the Constitution of India praying that in the circumstances stated in the
affidavit filed therewith, the High Court may be pleased to issue an appropriate
Writ, order or direction, more particularly one in the nature of a Writ of

Mandamus to declare the Order of the 3rd Respondent
Procgs.No.A1/456/2026, dt. 13-04-2026 as illegal, arbitrary, against the
Service Rules/Conduct Rules and violative of the provisions of Articles 14, 16,
19 and 300-A of Constitution of India and also violative of Principles of Natural
Justice and accordingly quash or set’aside the Order of 3^^^ Respondent vide
Procgs.No.A1/456/2026, dt.13- 04-2026 and the Consequential Orders being
passed by the 3^^^ Respondent, ii) To declare the Memo of the 2″^^ Respondent
vide Memo.No. XI/3130904/2026, dt.09-02-2026 as illegal, arbitrary, against
the Service Rules/Conduct Rules and violative of the provisions of Articles 14,
16, 19 and 300-A of Constitution of India and also violative of Principles of
Natural Justice and accordingly quash or set aside the Memo of 2″^^
Respondent vide Memo. No. XI/3130904/2026, dt.09- 02-2026 and the
consequential Memos or Orders, iii) To direct the Respondents 2 to 4 to
permit the Petitioner to discharge The Official Duties and Functions as Joint
Sub Registrar of Inkollu and to pass iany other appropriate Order/Orders as
this honble Court may deem fit or prdper in the circumstances of the case and
in the interests of Justice:
AND WHEREAS the High Court upon perusing the petition and affidavit
filed herein and upon hearing the arguments of Sri MIRUTHI SRINIVAS
MUNIPALLE, Advocate for the Petitioner, learned GP FOR SERVICES-I for
the Respondent Nos.1 to 4 directed issue of notice to the Respondents herein
to show cause as to why this WRIT PETITION should not be admitted.

Petition under Section ISFCPC is filed praying that ini the
circumstances stated in the grounds filed in support of the petition, the
High Court may be pleased to Suspend the operation of the order of 3’*^
Respondent, vide Procgs.No.A1/456/2026 dt. 13-04-2026, pending disposal of
WP No. 15649 of 2026, on the file of the High Court.

Petition under Section 151-CPC is filed praying that in the
circumstances stated in the grounds filed in support of the petition, the
high Court
may be pleased to direct the Respondents 2 to 4 to permit the
Petitioner to discharge the Official Duties and Functions as Joint Sub
Registrar of Inkollu since no Departmental Enquiry is conducted nor
any
Adverse Report against the Petitioner herein is served on him till date
pending disposal of WP No. 15649 of 2026, on the file of the High Court.
The Court made the following ORDER:
1. Notice before admission, returnable in four weeks.
2. The present Writ Petition is fiied questioning the order passed
by Respondent No.3 vide Procgs.No.A1/456/2026, dated 13.04.2026, asillegal and arbitrary.
3. The Petitioner was initially appointed as Sub-Registrar Grade-ll
through Andhra Pradesh Public Service Commission and was posted to
work at R.O-Narasaraopet (Zonei-lll). At present, the Petitioner wasworking as Joint Sub-Registrar at Inkollu.

4. At this juncture, a letter was addressed by the M.L.A of Parchur
Constituency to the Inspector “General, Registration and Stamps
Department alleging certain iliegaj registrations and gross deviations
being performed by the staff of the Sub-Registrar office of Inkollu. On
the basis of the said letter, the impugned orders came to be passed by
the Respondent No.3. Hence, the present Writ Petition came to be filed.
5. Heard the counsels.
6. The impugned order of “deputation” requires consent of both
the employee and the employer as said by the Hon’ble Supreme Court in
Umapati Choudhary vs. State of Bihar^. In the present case, in the
absence of any consent of the Petitioner, the impugned order cannot be
sustained. Therefore, pending further orders, there shall an interim order
as under:-
(i) The impugned order passed by Respondent No.3 vide
Procgs.No.A1/456/2026, dated 13:61^026 is suspended,
(ii) The Petitioner shall be continued to perform his duties at the
erstwhile place, subject to any disciplinary action/enquiry,
(iii) It is needless to mention that, this interim order does not come
in the way of initiating any disciplinary action/enquiry against the
Petitioner.
