(hereinafter referred to as ‘Impugned order’) passed
in Complaint Case No. 4938(C) of 2017 by the learned
A.C.J.M.-cum-Subordinate Judge-XVI, Patna, (hereinafter
referred to as ‘Magistrate’) whereby cognizance has been taken
for the offences punishable under Sections 384 and 504 of the
Indian Penal Code, 1860 against the present petitioners and
two other accused persons and summons have been directed
to be issued against them.
3. The prosecution case, in brief, as stated in
complaint, is that O.P. No.2 (Complainant) had established a
company in the name and style as ‘Otel Telecommunication
Pvt. Ltd.’ at New Delhi in January, 2016 and the petitioners
along with the co-accused had entered into a business
arrangement with the company. It is alleged that even before
commencement of the business, the accused persons started
demanding return of their investment along with profit and,
thereafter, began threatening O.P. No.2 and other directors. It
is further alleged that on 15.11.2017, O.P. No.2 received a
telephone call from the accused persons demanding Rs.50
lakhs as rangdari and threatening to kill him in case of non-
payment. It is also alleged that when O.P. No.2 approached
Patna High Court CR. MISC. No.20332 of 2018 dt.24-07-2026
the local police station, the police refused to register the case,
thereafter he filled complaint case bearing Complaint Case
No. 4938(C) of 2017 before the learned Magistrate.
