Heard the learned counsel Mr. S.C. Biswas appearing for the petitioner. Also

heard Mr. K. Baishya, the learned Addl. Public Prosecutor, Assam.
2. This application under Section 482 of the BNSS, 2023 has been filed by the
petitioner, namely- Ajay Paul, who is apprehending arrest in connection with PR Case
No.369/2025 (corresponding to Sukchar P.S. Case No.84/2023, under Sections
120B/406/379 of the Indian Penal Code) pending before the court of learned Chief
Judicial Magistrate, South Salmara, Mankachar.
3. The gist of accusations in this case is that on 04.03.2023 one Prasad Ch. Ray had
lodged an FIR before the Officer-in-Charge of Sukchar Police Station, inter alia,
alleging that during an inquiry by the informant, it was found many cattle are missing
from Go-Shala and pound and therefore, it was suspected that the cattle were stolen
or disposed of otherwise.
4. The learned counsel for the petitioner has submitted that in this case, charge
sheet has already been laid and the petitioner has received summons from the trial
court and on 03.06.2026. The petitioner filed an application before the trial court
seeking adjournment. He submits that the next date of the case is on 31.07.2026.
5. On consideration of the submissions made by the learned counsel for the
petitioner, this Court sees no apprehension of the petitioner getting arrested as the
trial court only issued summons to him and the trial court is competent enough to
consider the prayer for bail if such application is filed before the said court.
6. Hence, this anticipatory bail application is disposed of with an observation that if
so advised, the petitioner may move an application for bail before the trial court on
the next date fixed on 31.07.2026. On his appearance before the trial court, same
shall be considered as per law by the trial court.
