O R D E R
1) The instant petition has been filed by the
petitioner(husband) seeking transfer of Criminal
Case No. 1948 of 2024 (Case Crime No. 0600 of 2023)
titled as State of Uttarakhand v. Abhishek Sinha
pending before Additional Chief Judicial Magistrate,
Haldwani, District Nainital, Uttarakhand, to the
Court of Additional/Chief Judicial Magistrate,
Lucknow, or any Court at Lucknow, Uttar Pradesh
having equivalent and competent jurisdiction to
adjudicate the said case.

2) Initially, vide order dated 03.09.2025, by

consent, the parties were relegated for mediated

settlement but it could not be fructify. However,

TP (Crl.) No. 504/2025on their request, vide order dated 19.01.2026, the
parties were again referred to mediation when they
have entered into Settlement (Sulhanama) dated
19.01.2026 which has been placed before us.
3) Under the said settlement, it was decided that
subject to payment of Rs.12 lakhs, the parties shall
put a quietus to all litigations, even those which
are lodged by the family members, the details of
which have been given in para 8-I to para 8-XII.
Those conditions are reproduced as under:
8. That a settlement has been reached
between the two parties by mutual
consent and the differences between the
first party and the second party have
ended and both the parties agree to
settle the above case filed against
each other on the basis of mutual
consent, therefore both the parties
settle the matter by mutual consent
without any pressure and are bound by
the following conditions of the
settlement: –
I. That both the parties, Case No.
1948/2024; State vs Abhishek Sinha
arising under First Information Report
No. 0600/2023 Section 498-A, 323, 504
IPC, 1860 and 3, 4 Dowry Prohibition
Act, 1961, Police Station Haldwani,
District Nainital, Uttarakhand, agree
to settle the case (Quash) on the basis
of the compromise deed presented and
recommend that it be settled (Quash) on2

II. That the first party/plaintiff will
file necessary application supported by
affidavit to end/withdraw the
proceedings of case no. 273/2024,
Shikha Srivastava vs Abhishek Sinha,
under section-125 CrPC/144 BNSS,
District Lucknow, pending before the
court of Mr. Additional Chief Justice
Family Court-6, Lucknow and will get
the proceedings of the said case ended
by doing all necessary work. In which
the second party will fully cooperate.
III. That the second party no.1
(Abhishek Sinha) will file necessary
application supported by affidavit to
end or withdraw the proceedings of case
no. 4184/2023, Abhishek Sinha vs Shikha
Srivastava, under section 13 of Hindu
Marriage Act 1955, District Lucknow,
pending before the court of Ld
Additional Chief Justice, Family Court-
5, Lucknow and will get the proceedings
of the said case ended by doing all the
necessary work. In which the first
party will fully cooperate.
IV. The first party/plaintiff will file
the necessary application supported by
affidavit to end or withdraw the
proceedings of the Miscellaneous Case
pending before the Court of Mr.
Principal Additional Chief Justice
Family Court, Lucknow-5, Shikha
Srivastava vs. Abhishek Sinha, under
Section-24 Hindu Marriage Act 1955,
District Lucknow and will do all the
necessary work to end the proceedings
of the said case. The second party will
fully cooperate in this.

V. That the second party no. 2
(Priyanka Sinha) will file the
necessary application supported by
affidavit to end/withdraw the
proceedings of the case no. 57597/2024,
State of Uttar Pradesh vs. Shikha
Srivastava, under sections 323, 504 of
the Indian Penal Code, PS: Hazrat Ganj,
District Lucknow, pending before the
court of Chief Judicial Magistrate,
Lucknow and will do all the necessary
work to get the proceedings of the said
case ended and withdrawn. In which the
first party/plaintiff will fully
cooperate.
VI. That apart from the above, any
other legal proceedings which both the
parties have initiated against each
other, all such proceedings will be
automatically considered to be
terminated on the basis of the
presented settlement agreement.
VII. That both the parties will file a
suit for divorce by mutual consent
before the competent court and will
obtain a legal decree for divorce, in
which both the parties will fully
cooperate.
VIII. That the first party/plaintiff is
not entitled to receive any kind of
money nor will the first
party/plaintiff have any right to file
any suit or application in future for
receiving any kind of money:
maintenance, subsistence or in any
other item.
IX. That both the parties will fully
cooperate in settling the above case on4
TP (Crl.) No. 504/2025the basis of the presented compromise
and both the parties have no objection
to the above case being settled on the
basis of the presented compromise.
X. That both the parties will appear in
the court as and when required or
ordered by the court and will support
the compromise presented.
XI. That both the parties will not
claim any compensation in future.
XII. That the parties will never
interfere in each other’s life.
4) The parties are present in the Court who have
been identified by their respective counsel. On
interaction, they have accepted the terms of
settlement. Demand Draft No. 502300 dated
13.05.2026 of ICICI Bank for an amount of Rs.12
lakhs has been handed over to respondent No.2-wife
during hearing. Both the parties have stated that
they shall abide by the terms of the settlement,
however prayed for decree of divorce by mutual
consent. Interlocutory Application No. 137712 of
2026 for dissolution of marriage in furtherance
thereto has also been filed.
5) In view of the above, we are inclined to accept

the settlement agreement and to dispose of
Interlocutory Application No. 137712 of 2026 as also
this Transfer Petition with the following
directions:
(a) The petitioner(husband) has handed over
Demand Draft No. 502300 dated 13.05.2026 of
ICICI Bank for the settled amount of Rs.12
lakhs to respondent No. 2(wife) which is
accepted by her in the Court towards
permanent alimony, maintenance (past,
present, future) and by virtue of the same,
she would not have any other claim against
the petitioner(husband).
(b) The cases mentioned in para 8 of the
settlement agreement shall stand
quashed/disposed of and be consigned to the
record.
(c) Accepting the terms of the settlement
and as consented to by the parties, on
their request, in exercise of our
jurisdiction under Article 142 of the
Constitution, we grant decree of divorce by

marriage between the petitioner-
husband(Abhishek Sinha) and respondent
No.2-wife (Shikha Srivastav) shall stand
dissolved. By an outcome of the dissolution
of marriage, the parties set free to lead
their lives separately as per their own
will.
(d) The Settlement (Sulahanama) dated
19.01.2026 shall form part of this Order.
(d) Ordered accordingly.
6) Pending application(s), if any, shall stand
disposed of.
