    ​The​ ​issue​ ​involved​ ​in​ ​these​ ​Writ​ ​Petitions​ ​and​ ​the​ ​Devaswom​

    ​Board​ ​Application​ ​pertains​ ​to​ ​the​ ​uses​ ​to​ ​which​ ​the​ ​Thekkinkadu​ ​Maidan/​

    ​Vadakkumnatha Kshethra Maidan may be put.​

    ​2.​ ​Brief​ ​facts​ ​necessary​ ​for​ ​the​ ​disposal​ ​of​ ​these​ ​matters​ ​are​ ​as​

    ​follows:​

    ​WP(C) No. 24435 of 2025​

    ​3.​ ​The​​petitioner​​Sri.​​Madhu​​V.​​B.,​​states​​that​​he​​is​​a​​devotee​​of​​Sree​

    ​Thrisivaperur​ ​Vadakumnatha​ ​Temple.​ ​The​ ​temple​ ​is​ ​a​ ​very​ ​ancient​ ​temple​

    ​which​​is​​recognized​​as​​a​​world​​heritage​​structure​​by​​UNESCO.​ ​According​​to​​the​

    ​petitioner,​ ​this​ ​Court​ ​has​ ​issued​ ​various​ ​judgments​ ​and​ ​orders​ ​restricting​ ​the​

    ​use​ ​of​ ​Vadakkunatha​ ​Kshethra​ ​Maidan​ ​for​ ​public​ ​purposes.​ ​The​ ​petitioner​

    ​further​ ​contends​ ​that​ ​the​ ​respondents,​ ​Cochin​ ​Devaswom​ ​Board​ ​and​ ​its​

    ​officers,​ ​have​ ​flouted​ ​the​ ​orders​ ​by​ ​granting​ ​the​ ​Kshethra​ ​Maidan​ ​to​ ​political​

    ​and non-political organisations.​

    ​4.​ ​The​​petitioner​​further​​points​​out​​that​​music​​concerts,​​dances,​​and​

    ​other​​programs​​are​​being​​conducted​​in​​violation​​of​​the​​directions​​issued​​by​​this​

    ​Court​​from​​time​​to​​time.​​It​​is​​with​​these​​assertions​​that​​the​​petitioner​​in​​W.P.(C)​

    ​No. 24435 of 2025 seeks the following reliefs:​

    ​(1)​ ​ o​ ​issue​ ​a​ ​writ​ ​of​ ​mandamus,​ ​orders​ ​or​​directions,​​directing​

    ​the​​respondents​​1​​to​​4​​to​​forthwith​​stop​​granting​​permissions​
    ​to​ ​conduct​ ​any​ ​programs​​in​​any​​area​​of​​the​​Vadakkumnatha​
    ​Shetra​ ​Maidan​ ​to​ ​any​​political​​and​​non-political​​organization,​
    ​business​ ​establishments​ ​or​ ​other​ ​entrepreneurs​ ​to​ ​perform​
    ​their​​functions​​in​​the​​sacred​​premises​​of​​Shri​​Vadakkumnatha​
    ​Shetra Maidan.​

    ​(2)​ ​ o​ ​declare​ ​that​ ​the​ ​Vadakkumnatha​ ​Shetra​ ​Maidan​ ​can​ ​be​

    ​used only for the Temple related activities.​

    ​5.​ ​The​​petitioner,​​Sri.​​K.B.​​Sumod,​​states​​that​​he​​is​​a​​devotee​​of​​Sree​

    ​Vadakkumnatha​ ​Temple,​ ​Thrissur,​ ​which​ ​is​​managed​​by​​the​​Cochin​​Devaswom​

    ​Board​ ​(for​ ​the​ ​sake​ ​of​ ​brevity,​ ​’the​ ​Board’).​ ​The​ ​petitioner​ ​contends​​that​​the​

    ​official​ ​respondents,​ ​including​ ​the​ ​District​ ​Collector,​ ​City​ ​Police​ ​Commissioner,​

    ​the​ ​Cochin​ ​Devaswom​ ​Board​ ​and​ ​its​ ​officers,​ ​have​ ​intentionally​ ​violated​ ​the​

    ​directives​​issued​​by​​this​​Court​​and​​permitted​​the​​Thekkinkadu​​Kshethra​​Maidan​

    ​for​​uses​​other​​than​​those​​permitted​​by​​this​​Court​​in​​DBP​​No.​​48​​of​​2010,​​WP(C)​

    ​No.​ ​4617​ ​of​ ​2022​ ​and​ ​WP(C)​ ​26499​ ​of​ ​2018.​ ​The​ ​petitioner​ ​has​​produced​​a​

    ​copy​ ​of​ ​the​ ​common​ ​judgment​ ​in​ ​WP(C)​ ​No.​ ​4617/2022​ ​and​ ​WP(C)​ ​No.​

    ​26499/2018​ ​dated​ ​11.04.2023.​ ​According​ ​to​ ​the​ ​petitioner,​ ​the​ ​1st​
    ​W.P.(C) No.24435 of 2025 and connected cases​

    ​respondent,​ ​District​ ​Collector,​ ​is​ ​permitting​ ​the​ ​conduct​ ​of​ ​events​ ​in​ ​the​

    ​Thekkinkadu​ ​maidan​ ​without​ ​obtaining​ ​prior​ ​approval​ ​from​ ​this​ ​Court.​ ​The​

    ​petitioner​ ​has​ ​lodged​ ​various​ ​complaints​ ​before​ ​the​ ​1st​ ​and​​2nd​​respondents,​

    ​alleging​ ​that​ ​the​ ​official​ ​respondents​ ​have​ ​failed​ ​to​ ​strictly​ ​comply​ ​with​ ​the​

    ​orders of this Court.​

    ​6.​ ​The​​petitioner​​further​​states​​that​​the​​District​​Collector​​has​​granted​

    ​consent​ ​to​ ​organise​ ​a​ ​program​ ​’Ente​ ​Keralam​ ​-​ ​Vipanana​ ​Mela’​ ​(​എന്റെ​

    ​കേരളം​ ​വിപണന​ ​മേള​​)​ ​on​ ​12.05.2025​ ​at​ ​the​ ​Thekkinkadu​ ​Maidan​ ​without​

    ​any​ ​authorisation​ ​from​​this​​Court.​​He​​has​​produced​​a​​copy​​of​​the​​order​​of​​the​

    ​1st​ ​respondent​ ​dated​ ​12.05.2025,​ ​marked​ ​as​ ​Ext.P4.​ ​The​ ​petitioner​ ​further​

    ​contends​​that​​the​​Thekkinkadu​​maidan​​is​​also​​used​​for​​the​​events​​conducted​​by​

    ​political​ ​parties.​ ​It​ ​is​ ​in​ ​the​​said​​backdrop​​that​​the​​petitioner​​approached​​this​

    ​Court seeking the following reliefs:​

    ​(1)​ ​ irect​​1st​​respondent​​to​​strictly​​comply​​with​​the​​directions​​in​​the​​Ext.P1​

    ​judgment​ ​in​ ​WP(C)​ ​26499/2018​ ​and​ ​WP(C)​ ​4617/2022​ ​dated​
    ​12.04.2023,​ ​by​ ​the​ ​issue​ ​of​ ​a​ ​writ​ ​of​ ​mandamus​​or​​such​​other​​writ​​or​
    ​order or direction:​

    ​(2)​ ​ irect​ ​the​ ​2nd​ ​respondent​ ​to​ ​ensure​ ​that​ ​no​ ​programs​ ​or​ ​events​ ​are​

    ​conducted​ ​in​ ​Thekkinkadu​ ​Maidan,​ ​without​ ​the​ ​prior​ ​permissions​ ​from​
    ​this​ ​Hon’ble​ ​Court;​ ​by​ ​the​ ​issue​ ​of​ ​a​ ​writ​ ​of​ ​mandamus​ ​or​​such​​other​
    ​writ or order or direction;​

    ​7.​ ​The​​Cochin​​Devaswom​​Board​​has​​filed​​DBA​​No.9​​of​​2025​​seeking​
    ​W.P.(C) No.24435 of 2025 and connected cases​

    ​a​​declaration​​that​​the​​Board​​is​​not​​required​​to​​obtain​​permission​​from​​this​​Court​

    ​for​​letting​​out​​the​​Maidan​​other​​than​​for​​beautification/construction​​activities​​as​

    ​ordered in Annexure A2 order.​

    ​8.​ ​Thekkinkadu​ ​Maidan​ ​is​ ​an​ ​open​ ​ground​ ​located​ ​in​ ​the​ ​centre​ ​of​

    ​Thrissur​ ​City.​ ​The​​Maidan​​surrounds​​Sree​​Vadakkumnatha​​Temple,​​one​​of​​the​

    ​most​​significant​​Siva​​Temples​​in​​Kerala.​ ​It​​is​​stated​​in​​the​​DBA​​that​​the​​Maidan​

    ​is​​a​​circular​​ground,​​encircled​​by​​the​​Swaraj​​round,​​which​​is​​the​​main​​ring​​road​

    ​of​ ​Thrissur​ ​City.​ ​The​ ​petitioner​ ​has​ ​placed​ ​on​ ​record​ ​Annexure​ ​A1,​ ​a​

    ​topographic sketch showing the entire Maidan, including the Temple.​

    ​9.​ ​It​​is​​further​​stated​​in​​the​​DBA​​that​​Sree​​Vadakkumnatha​​Temple​​is​

    ​situated​ ​in​ ​9.5​ ​Acres​ ​of​ ​property.​ ​The​ ​total​​extent​​of​​the​​Maidan​​is​​59​​Acres,​

    ​out​ ​of​ ​which​ ​the​ ​Temple​ ​is​ ​situated​ ​in​ ​9.5​ ​acres,​ ​which​ ​is​ ​demarcated​ ​by​ ​a​

    ​compound wall.​

    ​10.​ ​Sri.​ ​K.​ ​R.​ ​Sunil,​ ​the​ ​learned​ ​counsel​ ​for​ ​the​ ​petitioner​ ​in​ ​W.P.(C)​

    ​No.24435​ ​of​ ​2025,​ ​submitted​ ​that​ ​a​ ​direction​ ​may​ ​be​ ​issued​ ​from​ ​this​ ​Court​

    ​stopping​​the​​grant​​of​​permission​​to​​conduct​​any​​programs​​in​​the​​Maidan​​to​​any​

    ​political​ ​and​ ​non-political​ ​organisations,​ ​business​ ​establishments,​ ​or​ ​other​

    ​entrepreneurs​​to​​perform​​their​​functions​​in​​the​​sacred​​premises​​of​​the​​Maidan.​

    ​The​ ​learned​ ​counsel​ ​would​ ​further​ ​submit​ ​that​ ​the​ ​Kshethra​ ​Maidan​ ​be​

    ​permitted to be used only for temple related activities.​

    ​11.​ ​Smt.​ ​Anupama​ ​Subramanian,​ ​the​ ​learned​ ​counsel​ ​for​ ​the​

    ​petitioner​ ​in​ ​W.P.(C)​ ​No.34749/2025​ ​submitted​ ​that​ ​a​ ​direction​ ​may​​be​​issued​

    ​to​​the​​Cochin​​Devaswom​​Board​​to​​ensure​​the​​strict​​compliance​​of​​the​​common​

    ​judgment​ ​in​ ​W.P.(C)​​Nos.26649/2018​​and​​4617/2022​​dated​​11.04.2023​​and​​to​

    ​ensure​ ​that​ ​no​​programs​​or​​events​​are​​to​​be​​conducted​​in​​the​​Maidan​​without​

    ​the​ ​prior​ ​permission​ ​from​ ​this​ ​Court.​ ​Profuse​ ​reliance​ ​was​ ​placed​ ​by​ ​the​

    ​learned counsel in​​A. A. Gopalakrishnan v. Cochin​​Devaswom Board​​1​

    ​12.​ ​Sri.​ ​K.​ ​P.​ ​Sudheer,​ ​the​ ​learned​ ​Standing​ ​Counsel​ ​for​ ​the​ ​Cochin​

    ​Devaswom​ ​Board,​ ​would​ ​submit​ ​that​ ​this​ ​Court​ ​had​ ​issued​ ​various​ ​directives​

    ​from​ ​time​ ​to​ ​time​ ​with​ ​regard​ ​to​ ​the​ ​purposes​ ​for​ ​which​ ​the​ ​Maidan​ ​can​ ​be​

    ​used.​ ​Directions​ ​were​ ​also​ ​issued​ ​to​ ​seek​ ​permission​ ​of​ ​this​ ​Court​ ​for​ ​the​

    ​conduct of programs and events in the Maidan.​

    ​13.​ ​The​ ​learned​ ​counsel​ ​further​ ​submitted​ ​that​ ​the​ ​requirement​ ​of​

    ​obtaining​ ​prior​ ​permission​ ​of​ ​this​ ​Court​ ​for​ ​the​ ​conduct​ ​of​ ​events​ ​in​ ​the​

    ​Kshethra​ ​Maidan,​ ​even​ ​for​ ​activities​ ​related​ ​to​ ​the​ ​temple,​ ​is​ ​causing​ ​many​

    ​hardships​ ​to​ ​the​ ​Board​ ​and​ ​the​ ​said​ ​prerequisite​ ​would​ ​result​ ​in​ ​the​ ​loss​ ​of​

    ​revenue​​to​​the​​Board.​ ​Therefore,​​the​​learned​​Standing​​Counsel​​seeks​​an​​order​

    ​from​ ​this​ ​Court​ ​permitting​ ​the​ ​Board​ ​to​ ​more​ ​effectively​ ​utilise​ ​the​ ​Maidan​

    ​without any prior permission​​from this Court.​

    ​14.​ ​The​ ​learned​ ​Standing​ ​Counsel​ ​has​ ​invited​ ​the​ ​attention​ ​of​ ​this​

    ​Court to numerous orders/judgments passed by this Court from 1990 onwards.​

    ​15.​ ​Annexure​ ​A2​ ​order​ ​was​ ​passed​ ​by​ ​a​ ​Coordinate​ ​Bench​ ​of​ ​this​

    ​Court​ ​on​ ​16.03.1990​ ​while​ ​considering​ ​a​ ​petition​ ​submitted​ ​by​ ​Sri.​

    ​Vijayaraghava Menon. Paragraph 2 of the order reads as follows :​

    “​ 2.​ ​While​ ​passing​ ​orders​ ​in​ ​the​ ​Petition,​ ​this​ ​Court​ ​on​
    ​22.02.1990​​interdicted​​the​​Board​​to​​deal​​in​​any​​manner​​with​​Thekkinkadu​
    ​maidan​​and​​appurtenant​​properties​​by​​way​​of​​grant​​of​​licence,​​or​​lease​​or​
    ​in​ ​any​ ​other​ ​manner.​ ​Even​ ​so,​ ​for​ ​the​ ​conduct​ ​of​ ​seasonal​ ​business​
    ​during​ ​’pooram’​ ​festival,​ ​this​ ​court​ ​granted​ ​permission​ ​in​​two​​instances:​
    ​one,​​for​​a​​vendor​​of​​water,​​melons,​​and​​the​​other,​​to​​conduct​​exhibitions.​
    ​We​​reiterate​​that​​the​​interdiction​​contained​​in​​the​​order​​dated​​22.2.1990​
    ​will​​stand.​ ​However,​​we​​make​​it​​clear​​that​​the​​said​​order​​shall​​not​​deter​
    ​the​​Cochin​​Devaswom​​Board​​from​​granting​​temporary​​licenses​​for​​proper​
    ​and​ ​adequate​ ​consideration,​ ​for​ ​conducting​ ​seasonal​ ​business​ ​during​
    ​’pooram’​ ​festival​ ​or​ ​such​ ​other​ ​festivals​ ​and​ ​during​ ​the​ ​period​ ​of​
    ​exhibition.​ ​The​ ​temporary​ ​licences​ ​are​ ​for​ ​vendors​ ​and​ ​hawkers​ ​to​
    ​conduct​ ​business​ ​only.​ ​The​​Board​​should​​see​​that​​no​​person​​erects​​any​
    ​permanent​​or​​semi-permanent​​structure​​in​​the​​said​​Thekkinkadu​​Maidan.​
    ​The petition is closed.”​

    ​16.​ ​On​ ​28.03.2003,​ ​by​ ​Annexure​ ​A3​ ​judgment,​ ​this​ ​Court​ ​permitted​

    ​the​ ​Board​ ​to​ ​use​ ​the​ ​Thekkinkad​ ​Maidan​ ​for​ ​the​ ​purposes​ ​mentioned​ ​in​

    ​Annexure​​R2(a)​​in​​O.P.​​No.8521​​of​​2003.​ ​In​​that​​matter,​​a​​Coordinate​​Bench​​of​

    ​this​ ​Court​ ​has​ ​considered​ ​the​ ​question​ ​whether​ ​the​ ​Maidan​​could​​be​​used​​for​

    ​religious​ ​purposes​ ​alone​ ​or​ ​not.​ ​The​ ​Bench,​ ​after​ ​considering​ ​the​ ​rival​

    ​submissions,​​held​​that​​the​​Thekkinkad​​Maidan​​can​​be​​put​​to​​any​​use​​which​​will​

    ​not​ ​affect​ ​the​ ​sentiments​ ​of​ ​the​ ​Hindu​ ​community.​ ​Paragraphs​​4,​​5,​​and​​6​​of​

    “​ 4.​ ​In​ ​the​ ​order​ ​referred​ ​to​ ​above,​ ​we​ ​have​ ​stated​ ​that​ ​the​
    ​Thekkinkad​​Maithanam​​should​​not​​be​​used​​for​​any​​non-religious​​purposes.​
    ​The​ ​argument​ ​of​ ​the​ ​petitioners​ ​and​ ​the​ ​Devaswom​ ​Board​ ​was​ ​that​ ​the​

    ​ ccording​ ​to​ ​them,​ ​these​ ​uses​ ​cannot​ ​be​ ​said​ ​to​ ​be​ ​against​ ​the​

    ​beliefs​​of​​the​​Hindus.​ ​Further,​​it​​is​​stated​​that​​the​​meeting,​​etc.​​are​​being​
    ​conducted​ ​far​ ​away​ ​from​ ​the​ ​Temple​ ​and​ ​it​ ​will​ ​in​ ​no​ ​way​ ​obstruct​ ​the​
    ​devotees from going to the Temple or obstruct any activity of the Temple.​

    ​ .​
    5 ​On​ ​the​ ​other​ ​hand,​ ​Sri.​ ​Govindh​ ​K.​ ​Bharathan​ ​submitted​
    ​that​ ​premises​ ​of​ ​the​ ​Temple​ ​which​ ​is​ ​a​ ​sanctuary​ ​should​ ​not​ ​be​​used​​for​
    ​any​​secular​​purposes,​​but​​can​​only​​be​​used​​for​​religious​​purposes.​ ​We​​are​
    ​told​ ​that​ ​the​ ​entire​ ​Thekkinkad​ ​Maithanam​ ​will​ ​be​ ​about​ ​nearly​​80​​acres.​
    ​According​ ​to​ ​us,​ ​the​​Thekkinkad​​Maithanam​​can​​be​​put​​to​​any​​use,​​which​
    ​will​​not​​affect​​the​​sentiments​​of​​the​​Hindu​​religion.​ ​Of​​course,​​earlier​​there​
    ​was​ ​an​ ​order​ ​preventing​ ​any​ ​semi-permanent​​or​​permanent​​constructions​
    ​there.​ ​After​ ​going​ ​through​ ​the​ ​list​ ​submitted​ ​by​ ​the​ ​Devaswom​ ​Board,​
    ​which​ ​is​ ​produced​ ​as​ ​Annexure​ ​R2(a),​ ​along​ ​with​ ​the​ ​statement,​ ​we​ ​are​
    ​satisfied​​that​​these​​purposes​​do​​not​​in​​any​​way​​affect​​the​​sentiments​​of​​the​
    ​Hindus.​ ​But​ ​we​ ​want​ ​to​ ​make​ ​it​ ​clear​ ​that​ ​even​ ​if​ ​the​ ​meeting​ ​can​ ​be​
    ​conducted,​ ​no​ ​”jatha”​ ​or​ ​anything​ ​like​ ​that​ ​can​ ​be​ ​conducted​ ​on​ ​the​
    ​premises.​

    ​ .​
    6 ​After​ ​hearing​ ​the​ ​parties,​ ​we​​allow​​the​​Cochin​​Devaswom​
    ​Board​ ​to​ ​use​ ​the​ ​Thekkinkad​ ​Maithanam​ ​for​ ​the​ ​purposes​ ​which​ ​are​
    ​mentioned​ ​in​ ​Annexure​ ​R2(a).​ ​Annexure​ ​R2(a)​ ​will​ ​be​ ​appended​ ​as​
    ​Annexure​ ​to​ ​this​ ​order.​ ​Hence​ ​we​ ​allow​ ​C.M.P.​ ​No.1975​ ​of​ ​2003,​ ​C.M.P.​
    ​No.1977​ ​of​ ​2003,​ ​C.M.P.​ ​No.1808​ ​of​ ​2003​ ​and​ ​O.P.​ ​No.8521​ ​of​ ​2003.”​

    ​17.​ ​In​ ​Annexure​ ​A4​ ​order​ ​dated​ ​08.06.2011​ ​in​ ​DBP​ ​No.48​ ​of​ ​2010,​

    ​this​ ​Court​ ​has​ ​passed​ ​a​ ​detailed​​interim​​order​​with​​regard​​to​​the​​afforestation​

    ​activities​ ​in​ ​the​ ​Maidan​ ​and​ ​prohibiting​ ​construction​ ​activity​ ​by​ ​the​ ​Cochin​

    ​Devaswom​ ​Board​ ​in​ ​the​ ​Maidan​ ​without​ ​specific​ ​orders​ ​from​ ​this​ ​Court.​

    ​However,​ ​the​ ​prohibition​ ​was​ ​not​ ​applicable​ ​to​ ​temporary​ ​structures​ ​of​ ​the​

    ​Poorams and rituals. Relevant paragraphs of the interim order read thus :​

    “​ 7.​ ​In​​the​​light​​of​​the​​above​​and​​taking​​into​​consideration​​the​
    ​report​ ​of​ ​the​ ​learned​ ​Ombudsman,​ ​it​​is​​directed​​that​​henceforth​​there​
    ​shall​ ​be​ ​no​ ​construction,​ ​beautification​ ​or​ ​other​ ​activities​ ​in​ ​the​
    ​Thekkinkadu​​Maidan​​by​​the​​Government​​or​​the​​Corporation​​of​​Thrissur​
    ​or​​any​​other​​authority​​without​​obtaining​​specific​​orders​​from​​this​​Court.​
    ​The​​Cochin​​Devaswom​​Board​​will​​protect​​the​​said​​Maidan​​appropriately​
    ​since​​it​​is​​the​​property​​of​​the​​Cochin​​Devaswom​​Board.​ ​We​​also​​direct​
    ​that​ ​the​ ​District​ ​Collector​ ​will​ ​ensure​ ​that​ ​the​ ​directions​ ​in​ ​this​ ​order​
    ​regarding​ ​preservation​ ​of​ ​the​ ​Thekkinkadu​ ​Maidan​ ​is​ ​appropriately​
    ​supported​ ​by​ ​the​ ​District​ ​Administration.​ ​Insofar​ ​as​ ​the​ ​’Jaladhara’​
    ​which​ ​has​ ​become​ ​defunct​ ​and​ ​has​ ​turned​ ​out​ ​to​ ​be​ ​the​ ​hub​ ​of​
    ​antisocial​ ​elements​ ​is​ ​concerned,​ ​the​ ​Secretary,​ ​Cochin​ ​Devaswom​
    ​Board​ ​is​ ​directed​ ​to​ ​ensure​ ​that​ ​the​​same​​is​​demolished​​and​​removed​
    ​within​ ​a​ ​period​ ​of​ ​one​ ​month​ ​from​ ​now​ ​without​ ​fail.​ ​A​​report​​in​​that​
    ​regard​​shall​​be​​placed​​on​​record​​within​​a​​period​​of​​forty​​five​​days​​from​
    ​today.​

    ​ .​ ​In​ ​consonance​ ​of​ ​the​ ​above,​ ​we​ ​further​ ​direct​ ​the​

    ​Secretary​ ​of​ ​the​ ​Board​ ​to​ ​file​ ​an​ ​affidavit​ ​within​ ​a​ ​period​ ​of​​forty​​five​
    ​days​ ​from​ ​today​ ​identifying​ ​the​ ​location​ ​in​ ​the​ ​Thekkinkadu​ ​Maidan​
    ​where​ ​afforestation​ ​activity​ ​can​ ​be​ ​taken​ ​up.​ ​The​​views​​of​​the​​forest​
    ​officials​ ​having​ ​jurisdiction​ ​over​ ​the​ ​area​ ​will​ ​also​ ​be​ ​specifically​
    ​obtained as regards the type of saplings and other aspects.​

    ​ .​ ​Having​ ​regard​ ​to​ ​the​ ​fact​​that​​the​​Thekkinkadu​​Maidan​​is​

    ​vested​ ​with​ ​the​ ​Cochin​ ​Devaswom​ ​Board,​ ​we​​are​​of​​the​​view​​that​​the​
    ​Government​ ​or​ ​the​ ​Corporation​ ​cannot​ ​independently​ ​decide​ ​on​ ​its​
    ​beautification​ ​and​ ​therefore​ ​we​ ​direct​ ​that​ ​all​​proposals​​in​​that​​regard​
    ​which​ ​have​ ​been​ ​taken​ ​up​ ​without​ ​the​ ​clearance​ ​of​ ​the​ ​Cochin​
    ​Devaswom​ ​Board​ ​will​ ​stand​ ​stayed​ ​until​ ​further​ ​orders.​ ​It​ ​is​ ​further​
    ​directed​ ​that​ ​there​ ​shall​ ​be​ ​no​ ​construction​ ​activity​ ​by​ ​the​ ​Cochin​
    ​Devaswom​​Board​​in​​the​​Thekkinkadu​​Maidan​​without​​obtaining​​specific​
    ​orders​ ​from​ ​this​ ​Court.​ ​This​ ​inhibition​ ​will​ ​not​ ​cover​ ​such​ ​temporary​
    ​structures​ ​which​ ​are​ ​necessary​ ​such​ ​as​ ​festival,​ ​Pooram​ ​and​​rituals​​in​
    ​connection therewith as is held hitherto, exhibition etc.​

    ​ 0.​ ​We​ ​are​ ​also​ ​told​ ​that​ ​there​ ​are​ ​no​ ​hoardings​ ​and​

    ​advertisement​ ​boards​​inside​​the​​Thekkinkadu​​Maidan.​ ​We​​also​​further​

    ​ irect​ ​that​ ​the​ ​Secretary,​​Cochin​​Devaswom​​Board​​will​​ensure​​that​​the​
    d
    ​entire​ ​Thekkinkadu​ ​Maidan​ ​is​ ​kept​ ​plastic​ ​free.​ ​The​ ​Secretary​ ​of​ ​the​
    ​Thrissur​ ​Corporation​ ​is​ ​also​ ​directed​ ​to​ ​ensure​ ​that​ ​the​ ​environment​
    ​safety​ ​levels​ ​are​ ​maintained​ ​in​ ​connection​ ​with​ ​plastic​ ​and​
    ​non-biodegradable​ ​and​ ​also​ ​biodegradable​ ​substances​ ​insofar​ ​as​
    ​Thekkinkadu​ ​Maidan​ ​is​ ​concerned,​ ​particularly​ ​because​ ​it​ ​is​ ​an​ ​area​
    ​which attracts the public.”​

    ​The​ ​aforesaid​ ​DBP​ ​was​ ​finally​ ​disposed​ ​of​ ​by​ ​this​ ​Court​ ​by​ ​order​ ​dated​

    ​08.07.2013.​ ​A​ ​copy​ ​of​ ​the​ ​order​​was​​produced​​as​​Annexure​​A5,​​whereby​​the​

    ​interim order passed by this Court was made absolute.​

    ​18.​ ​The​ ​Cochin​ ​Devaswom​ ​Board​ ​has​ ​approached​ ​this​ ​Court​ ​and​

    ​preferred​​O.P.​​No.8521​​of​​2003​​and​​connected​​cases​​seeking​​permission​​to​​use​

    ​the​ ​Maidan​ ​for​ ​other​ ​purposes,​ ​which​ ​were​ ​not​ ​approved​ ​by​ ​this​ ​Court​ ​in​

    ​Annexure​ ​A3​ ​judgment​ ​dated​ ​28.03.2003.​ ​However,​ ​this​ ​Court​ ​has​ ​turned​

    ​down​ ​the​ ​request​ ​of​ ​the​ ​Cochin​ ​Devaswom​ ​Board​ ​vide​ ​Annexure​ ​A6​ ​order​

    ​dated​ ​30.09.2013​ ​in​ ​DBP​ ​No.78​ ​of​​2013.​ ​Paragraph​​6​​of​​the​​said​​order​​reads​

    ​as follows :​

    “​ 6.​ ​We​​are​​of​​the​​view​​that​​if​​any​​other​​unrestricted​​activities​
    ​are​ ​permitted,​ ​it​ ​will​ ​have​ ​an​​adverse​​impact​​on​​the​​property​​which​​is​
    ​one​ ​of​ ​the​ ​important​ ​locations​ ​as​ ​far​ ​as​​the​​entire​​town​​is​​concerned.​
    ​Therefore,​ ​the​ ​order​ ​passed​ ​by​ ​this​ ​Court​ ​in​​DBP​​48​​of​​2010​​will​​take​
    ​care​ ​of​ ​all​ ​matters​ ​which​ ​may​ ​arise​ ​in​ ​future.​ ​We​ ​further​ ​clarify​​that​
    ​whenever​ ​fresh​ ​applications​ ​or​ ​proposals​ ​are​ ​received​ ​from​ ​interested​
    ​parties,​ ​Devaswom​ ​Board​ ​will​ ​place​ ​the​ ​matter​ ​before​ ​this​ ​Court​ ​for​
    ​consideration​​and​​only​​after​​sanction​​by​​this​​Court​​any​​such​​activity​​can​
    ​be permitted.”​

    ​19.​ ​Later,​ ​based​ ​on​ ​the​ ​report​ ​of​​the​​Board,​​DBP​​No.31​​of​​2022​​was​
    ​W.P.(C) No.24435 of 2025 and connected cases​

    ​filed​ ​stating​ ​that​ ​due​ ​to​ ​the​ ​COVID-19​ ​pandemic​ ​and​ ​other​ ​reasons,​ ​the​

    ​temples​​under​​the​​management​​of​​the​​Cochin​​Devaswom​​Board​​were​​facing​​an​

    ​acute​ ​financial​ ​crisis​ ​and​ ​seeking​ ​permission​ ​of​ ​this​ ​Court​ ​to​ ​conduct​ ​an​

    ​exhibition/trade​ ​fair​ ​in​ ​the​ ​Thrissur​ ​Pooram​ ​Exhibition​ ​ground.​ ​The​ ​said​ ​DBP​

    ​was​​disposed​​of​​by​​this​​Court​​vide​​order​​dated​​29.07.2022​​(Annexure​​A8).​ ​The​

    ​Devaswom​ ​Bench​ ​of​ ​this​ ​Court,​ ​after​ ​a​ ​detailed​ ​consideration​ ​of​ ​the​

    ​submissions​ ​and​ ​the​ ​report​ ​of​ ​the​ ​learned​ ​Ombudsman,​ ​has​ ​disposed​ ​of​ ​the​

    ​petition with the following directions :​

    ​”29.​ ​Considering​ ​the​ ​fact​ ​that​ ​Cochin​ ​Devaswom​ ​Board​ ​is​
    f​acing​ ​acute​ ​financial​ ​crisis​ ​due​ ​to​ ​Covid-19​ ​pandemic​ ​and​ ​other​
    ​reasons,​ ​which​ ​is​ ​not​ ​in​ ​serious​ ​dispute,​ ​we​ ​deem​ ​it​ ​appropriate​ ​to​
    ​grant​ ​permission​ ​to​ ​the​ ​Board​ ​to​ ​conduct​​Onam​​exhibition/trade​​fair​
    ​in​ ​Thrissur​ ​Pooram​ ​exhibition​ ​ground​ ​in​ ​Thekkinkad​ ​Maidan,​ ​for​ ​the​
    ​current​ ​year,​ ​i.e.,​ ​2022,​ ​subject​ ​to​ ​the​ ​condition​ ​that​​the​​conduct​​of​
    ​exhibition/trade​ ​fair​ ​shall​ ​be​ ​confined​ ​to​ ​the​ ​exhibition​ ​ground​ ​in​
    ​Thekkinkad​​Maidan​​where​​there​​is​​no​​afforestation​​activity​​by​​planting​
    ​teak or such other trees.​

    ​ 9.1.​​There​​shall​​be​​no​​semi​​or​​permanent​​construction​​in​​the​

    ​exhibition​ ​ground​ ​in​ ​connection​ ​with​ ​the​ ​Onam​ ​exhibition/trade​ ​fair.​
    ​Only​ ​temporary​ ​structures​ ​shall​ ​be​ ​erected​ ​in​ ​the​​exhibition​​ground,​
    ​as​​per​​the​​layout​​in​​Annexure​​A8​​of​​the​​proposed​​exhibition​​stalls​​and​
    ​pavilions​​produced​​along​​with​​the​​memo​​filed​​by​​the​​learned​​Standing​
    ​Counsel​ ​for​ ​the​ ​Board​ ​dated​ ​19.07.2022.​ ​The​ ​Board​ ​shall​ ​obtain​
    ​necessary​ ​licence/​ ​permission/consent​ ​from​ ​the​ ​statutory​ ​authorities​
    ​for​​the​​conduct​​of​​Onam​​exhibition/trade​​fair​​in​​the​​exhibition​​ground.​
    ​The​ ​traders​ ​shall​ ​obtain​ ​necessary​ ​licence/permission/​ ​consent​ ​from​
    ​the​ ​statutory​ ​authorities,​ ​for​ ​the​ ​respective​ ​stalls/pavilions.​ ​The​
    ​activities​ ​in​ ​connection​ ​with​ ​Onam​ ​exhibition/trade​ ​fair​ ​shall​ ​in​ ​no​
    ​manner affect the afforestation activity in Thekkinkad Maidan.​

    ​ 9.2.​ ​The​ ​Board​ ​shall​ ​conduct​ ​an​ ​auction​ ​of​ ​the​ ​right​ ​to​

    ​ ccordance​ ​with​ ​law,​ ​and​ ​the​ ​layout​ ​of​ ​the​ ​stalls/pavilions​ ​shall​ ​be​
    a
    ​published​ ​in​ ​its​ ​official​ ​website,​ ​along​ ​with​ ​other​ ​particulars.​ ​The​
    ​Board​​shall​​publish​​notices​​inviting​​tenders​​in​​leading​​dailies,​​in​​order​
    ​to​ ​ensure​ ​wide​ ​publicity.​ ​In​ ​the​ ​said​ ​notice​ ​it​ ​shall​ ​be​ ​specified​​that​
    ​the​​layout​​of​​the​​stalls/pavilions​​and​​other​​particulars​​are​​available​​in​
    ​its​ ​official​ ​website.​ ​The​ ​Board​ ​shall​ ​also​ ​consider​ ​the​ ​feasibility​ ​of​
    ​conducting​​e-tender,​​giving​​option​​to​​the​​traders​​to​​quote​​the​​amount​
    ​for individual stalls/pavilions.​

    ​ 9.3.​​The​​Board​​shall​​ensure​​that​​proper​​income​​is​​generated​

    ​by​ ​conducting​ ​auction​ ​of​ ​the​ ​right​ ​to​ ​conduct​ ​stalls/pavilions​ ​in​ ​the​
    ​Onam​ ​exhibition/trade​ ​fair.​ ​In​ ​such​ ​transactions,​ ​the​ ​Board​ ​and​ ​its​
    ​officials​ ​have​ ​to​ ​show​ ​due​ ​diligence​ ​in​ ​the​ ​manner​ ​of​ ​an​ ​ordinary​
    ​prudent​​man​​of​​business​​to​​conduct​​his​​own​​affairs,​​since​​the​​Board​​is​
    ​essentially​​a​​trustee​​of​​Devaswom​​land​​which​​vests​​in​​the​​deity.​​Since​
    ​Thekkinkad​ ​Maidan​ ​is​ ​a​ ​Devaswom​ ​property​ ​no​ ​sale/trade​ ​of​ ​any​
    ​objectionable​​substances​​shall​​be​​permitted​​in​​Onam​​exhibition/trade​
    ​fair in the exhibition ground.​

    ​ 9.4.​ ​The​ ​terms​ ​and​ ​conditions​ ​and​​other​​matters​​relating​​to​

    ​the​ ​conduct​ ​of​ ​Onam​ ​exhibition/trade​ ​fair​​shall​​be​​placed​​before​​the​
    ​learned​ ​Ombudsman​ ​for​ ​approval.​ ​The​ ​expenditure​ ​incurred​ ​by​ ​the​
    ​Board​ ​in​ ​connection​ ​with​ ​the​ ​conduct​ ​of​ ​Onam​ ​exhibition/trade​ ​fair​
    ​and​ ​also​ ​the​ ​income​ ​generated​​therefrom,​​by​​auctioning​​the​​right​​to​
    ​conduct​​stalls/pavilions,​​shall​​be​​subjected​​to​​audit​​by​​the​​State​​Audit​
    ​Department, immediately after the exhibition/trade fair is over.”​

    ​20.​ ​This​ ​Court​ ​has​ ​again​ ​intervened​ ​in​ ​the​ ​matter​ ​pertaining​ ​to​ ​the​

    ​Maidan​ ​by​ ​Annexure​ ​A9​ ​judgment​ ​dated​ ​11.04.2023​​in​​the​​Writ​​Petitions​​filed​

    ​by​ ​Sri.​ ​K.​ ​B.​ ​Sumod,​ ​as​ ​W.P.(C)​ ​Nos.26499/2018​ ​and​ ​4617​ ​of​ ​2022.​ ​In​ ​that​

    ​judgment,​ ​this​ ​Court​ ​has​ ​issued​ ​various​ ​directives​ ​restricting​ ​the​ ​use​ ​of​ ​the​

    ​Maidan. The relevant paragraphs of the said judgment are as follows :​

    “​ 49.​ ​In​ ​view​ ​of​ ​the​ ​law​​laid​​down​​by​​this​​Court​​in​​Satheesh​
    ​[2022​ ​(1)​ ​KLT​ ​940]​ ​the​ ​roads​ ​constructed​ ​as​ ​per​ ​the​​specifications​

    ​ nd​ ​standards​ ​prescribed​ ​by​ ​the​ ​Indian​ ​Roads​ ​Congress​ ​are​ ​for​
    a
    ​vehicular​ ​traffic,​ ​which​ ​cannot​ ​be​ ​converted​ ​as​ ​a​ ​parking​ ​space​ ​for​
    ​commercial​ ​or​​other​​establishments,​​religious​​institutions,​​etc.,​​or​​even​
    ​for​ ​putting​ ​up​ ​temporary​ ​structures​ ​in​ ​connection​ ​with​ ​festivals​ ​in​
    ​temples,​​churches,​​mosque,​​etc.,​​or​​for​​putting​​up​​temporary​​structures​
    ​as​ ​resting​ ​place​ ​for​ ​headload​ ​workers,​ ​etc.,​ ​or​ ​for​ ​putting​ ​up​ ​bus​
    ​shelters by political parties​​or by any other organisations.​

    ​ 0.​​Since​​the​​State​​holds​​public​​roads​​as​​a​​trustee​​on​​behalf​​of​

    ​the​ ​public​​,​ ​the​ ​inaction​ ​on​ ​the​ ​part​ ​of​ ​the​ ​State​ ​and​ ​the​ ​Local​ ​Self​
    ​Government​ ​Institutions​ ​in​ ​preventing​ ​such​ ​encroachments​ ​upon​
    ​footpaths​​or​​right​​of​​way​​of​​public​​roads​​will​​amount​​to​​breach​​of​​trust​​.​
    ​Any​ ​failure​ ​on​ ​the​ ​part​ ​of​ ​the​ ​designated​ ​authorities,​ ​contractor,​
    ​consultant​ ​or​ ​concessionaire​ ​in​ ​maintaining​ ​the​ ​safety​ ​standards​ ​of​
    ​public​​roads​​will​​attract​​the​​penal​​consequences​​provided​​under​​Section​
    ​198A of the Motor Vehicles Act, 1988.​

    ​ 1.​ ​The​​Cochin​​Devaswom​​Board​​and​​its​​officials​​shall​​ensure​

    ​strict​ ​compliance​ ​of​ ​the​ ​law​ ​laid​ ​down​ ​by​ ​this​ ​Court​ ​in​ ​Satheesh​
    ​[2022​​(1)​​KLT​​940]​​in​​respect​​of​​all​​temples​​under​​its​​management,​
    ​by​ ​ensuring​ ​that​ ​no​ ​hoardings,​ ​advertisement​ ​boards,​ ​etc.,​ ​or​ ​any​
    ​temporary​ ​structures​ ​are​ ​erected​ ​on​ ​the​ ​right​ ​of​ ​way​ ​or​ ​pedestrian​
    ​facilities​ ​of​ ​public​ ​roads​ ​around​ ​the​ ​premises​ ​of​ ​the​​temples​​under​​its​
    ​management,​ ​in​ ​connection​ ​with​ ​annual​ ​festival​ ​and​ ​other​ ​religious​
    ​ceremonies.​​The​​additional​​6th​​respondent​​in​​W.P.(C)No.26499​​of​​2018,​
    ​i.e.,​ ​the​ ​Secretary​ ​of​ ​Thrissur​ ​Municipal​ ​Corporation​ ​shall​​ensure​​strict​
    ​compliance​​of​​the​​law​​laid​​down​​by​​this​​Court​​in​​Satheesh​​[2022​​(1)​
    ​KLT​ ​940]​ ​by​ ​ensuring​ ​that​ ​no​ ​hoardings,​ ​advertisement​​boards,​​etc.,​
    ​or​ ​any​ ​temporary​ ​structures​ ​are​ ​erected​ ​on​ ​the​ ​right​ ​of​ ​way​ ​or​
    ​pedestrian​​facilities​​of​​public​​roads​​within​​the​​area​​of​​Thrissur​​Municipal​
    ​Corporation,​ ​forcing​ ​pedestrians​ ​including​ ​those​ ​with​ ​disabilities​ ​and​
    ​reduced mobility to walk in unsafe circumstances.”​

    ​21.​ ​While​ ​disposing​ ​of​ ​the​ ​Contempt​ ​Case​ ​No.2824​ ​of​ ​2023​ ​filed​ ​by​

    ​Sri.​ ​K.​ ​A.​ ​Sumod,​ ​this​ ​Court​ ​observed​ ​in​ ​paragraph​ ​6​ ​of​ ​Annexure​ ​A10​

    ​judgment dated 25.07.2025 as follows :​

    “​ 6.​​During​​the​​pendency​​of​​this​​contempt​​case,​​another​​devotee​
    ​of​ ​Lord​ ​Vadakkumnathan​ ​has​ ​filed​​W.P.(C)No.24435​​of​​2025​​seeking​​a​
    ​writ​ ​of​ ​mandamus​ ​commanding​ ​respondents​ ​1​ ​to​ ​4​ ​to​ ​stop​ ​granting​
    ​permission​​to​​conduct​​any​​programs​​in​​any​​area​​of​​the​​Vadakkumnatha​
    ​Kshethra​​Maidan​​to​​any​​political​​and​​nonpolitical​​organisations,​​business​
    ​establishments​​or​​other​​entrepreneurs​​to​​perform​​their​​functions​​in​​the​
    ​sacred​ ​premises​ ​of​ ​Sree​ ​Vadakkumnatha​ ​Kshethra​ ​Maidan​ ​and​ ​to​
    ​declare​​that​​the​​Vadakkumnatha​​Kshethra​​Maidan​​can​​be​​used​​only​​for​
    ​temple​ ​related​ ​activities.​ ​The​ ​said​ ​writ​ ​petition​ ​is​ ​pending​
    ​consideration.”​

    ​22.​ ​Sri.​ ​K.​ ​P.​ ​Sudheer,​ ​the​ ​learned​ ​Standing​ ​Counsel​ ​for​ ​the​ ​Cochin​

    ​Devaswom​​Board,​​submitted​​that​​in​​view​​of​​the​​various​​directives​​issued​​by​​this​

    ​Court​​in​​the​​orders​​and​​judgments​​referred​​to​​above,​​the​​Thekkinkadu​​Maidan​

    ​cannot​ ​be​ ​effectively​ ​used​ ​by​ ​the​ ​Cochin​ ​Devaswom​ ​Board.​ ​At​ ​present,​ ​the​

    ​Board​​has​​to​​obtain​​prior​​permission​​from​​this​​Court​​for​​letting​​out​​a​​portion​​of​

    ​the​ ​property​ ​for​ ​religious,​ ​cultural​ ​and​ ​commercial​ ​purposes.​ ​The​ ​procedural​

    ​delay​ ​in​ ​making​ ​applications​ ​to​ ​this​ ​Court​ ​and​ ​getting​ ​permission​ ​from​ ​this​

    ​Court​ ​would​ ​practically​ ​persuade​ ​the​ ​prospective​ ​lessees​ ​to​ ​opt​ ​for​ ​other​

    ​venues for conducting programs and events.​

    ​23.​ ​The​ ​learned​ ​Standing​ ​Counsel​ ​has​ ​pointed​ ​out​ ​that​ ​several​

    ​queries​​and​​enquiries​​are​​received​​from​​the​​prospective​​lessees​​who​​would​​like​

    ​to​ ​conduct​ ​events​ ​in​ ​the​ ​Maidan.​ ​However,​ ​the​ ​Board​ ​officials​ ​are​ ​unable​ ​to​

    ​give a specific reply and to fix a date for the conduct of the events.​

    ​24.​ ​The​ ​learned​ ​Standing​ ​Counsel​ ​submitted​​that​​the​​Board​​is​​facing​

    ​an​ ​acute​ ​financial​ ​crisis​ ​and​ ​is​ ​unable​ ​to​ ​manage​ ​all​ ​409​ ​temples​ ​under​ ​its​

    ​control​​effectively.​ ​The​​learned​​counsel​​has​​urged​​that​​if​​a​​declaration​​is​​made​

    ​to​​the​​effect​​that​​no​​permission​​need​​be​​obtained​​from​​this​​Court​​for​​letting​​out​

    ​the​​Maidan​​for​​religious,​​cultural​​or​​other​​events,​​it​​would​​be​​a​​great​​solace​​and​

    ​the​ ​Board​​can​​thereby​​augment​​its​​income​​by​​letting​​out​​some​​portions​​of​​the​

    ​Maidan to the prospective lessees.​

    ​25.​ ​The​ ​learned​ ​Standing​ ​Counsel​ ​further​ ​pointed​ ​out​ ​that​ ​the​

    ​exhibition​ ​ground​ ​is​ ​let​ ​out​ ​only​ ​for​ ​the​ ​Thrissur​ ​Pooram​ ​exhibition​ ​from​

    ​February​ ​to​ ​June.​ ​The​ ​income​ ​generated​ ​by​ ​the​ ​letting​ ​out​ ​of​ ​the​ ​exhibition​

    ​ground​​is​​meagre.​ ​The​​exhibition​​ground​​is​​kept​​unused​​during​​the​​rest​​of​​the​

    ​year.​ ​The​ ​learned​​counsel​​has​​pointed​​out​​that​​the​​exhibition​​ground​​situated​

    ​on​​the​​north-eastern​​portion​​of​​the​​Maidan​​could​​be​​more​​effectively​​utilised​​by​

    ​letting it out for the conduct of some events from July to January.​

    ​26.​ ​The​​learned​​Standing​​Counsel​​has​​pointed​​out​​that​​DBP​​Nos.​ ​9​​of​

    ​2023​ ​and​ ​72​ ​of​ ​2025​ ​are​ ​pending​ ​before​ ​this​ ​Court​ ​with​ ​respect​ ​to​ ​the​

    ​restoration​ ​and​ ​conservation​ ​of​ ​Vadakkumnatha​ ​Temple​ ​and​ ​its​ ​premises​ ​and​

    ​the​ ​implementation​ ​of​ ​the​ ​master​ ​plan​ ​prepared​ ​by​ ​the​ ​Indian​ ​National​ ​Trust​

    ​for​​Art​​and​​Cultural​​Heritage​​(INTACH),​​which​​includes​​the​​beautification​​of​​the​

    ​Vadakkumnatha​​Kshethra​​Maidan.​ ​A​​detailed​​plan​​has​​been​​prepared​​by​​Indian​

    ​National​ ​Trust​ ​for​ ​Art​ ​and​ ​Cultural​ ​Heritage​ ​(INTACH),​ ​a​ ​non-profit​ ​charitable​
    ​W.P.(C) No.24435 of 2025 and connected cases​

    ​organisation​ ​registered​​under​​the​​Societies​​Registration​​Act,​​1860,​​founded​​for​

    ​pioneering​ ​the​ ​conservation​ ​and​ ​protection​ ​of​ ​India’s​ ​natural​ ​and​ ​cultural​

    ​heritage.​ ​By​ ​order​ ​dated​ ​02.07.2026,​ ​this​ ​Court​ ​had​ ​granted​ ​permission​ ​to​

    ​proceed​​with​​the​​master​​plan.​​The​​learned​​Standing​​Counsel​​submitted​​that​​the​

    ​additional​​income​​which​​might​​have​​accrued​​by​​letting​​out​​the​​various​​portions​

    ​of​ ​the​ ​Maidan​ ​may​ ​be​ ​utilised​ ​for​ ​the​ ​implementation​ ​of​ ​the​ ​master​​plan​​and​

    ​the​ ​beautification​ ​of​ ​the​ ​Maidan/restoration​ ​and​ ​conservation​ ​of​

    ​Vadakkumnatha Temple and its premises.​

    ​27.​ ​Sri.​ ​K.​ ​R.​ ​Sunil,​ ​the​ ​learned​ ​counsel,​ ​has​ ​submitted​ ​that​ ​the​

    ​Kshethra​ ​Maidan​ ​could​ ​be​ ​permitted​ ​to​ ​be​ ​used​ ​only​ ​for​ ​religious​ ​activities,​

    ​exhibitions,​ ​and​ ​allied​ ​activities​ ​in​ ​terms​ ​of​ ​the​ ​directives​ ​issued​​by​​this​​Court​

    ​from​ ​time​ ​to​ ​time.​ ​According​ ​to​ ​the​ ​learned​ ​counsel,​ ​the​ ​Cochin​ ​Devaswom​

    ​Board​ ​and​ ​its​ ​officials​ ​have​ ​flouted​ ​the​ ​orders​ ​of​ ​this​ ​Court​ ​by​ ​granting​ ​the​

    ​Kshethra​ ​Maidan​ ​to​ ​political​ ​and​ ​non-political​ ​organisations.​ ​Moreover,​ ​it​ ​is​

    ​pointed​ ​out​ ​that​ ​musical​ ​concerts,​ ​dances,​ ​etc.,​ ​are​ ​being​ ​performed​ ​in​ ​the​

    ​Maidan,​ ​affecting​ ​the​ ​religious​ ​sentiments​ ​of​ ​the​ ​Hindu​ ​community.​ ​The​

    ​learned​​counsel​​further​​submitted​​that​​the​​Government​​or​​the​​Heads​​of​​various​

    ​departments​ ​have​ ​no​ ​authority​ ​to​ ​permit​ ​the​ ​Maidan​ ​for​ ​other​ ​purposes.​ ​In​

    ​conducted in the Maidan without prior permission from this Court.​

    ​counsel​ ​for​ ​the​ ​petitioner​ ​in​ ​W.P.(C)​ ​No.24435/2025,​ ​Smt.​ ​Anupama​

    ​Subramanian,​ ​the​ ​learned​ ​counsel​ ​for​​the​​petitioner​​in​​W.P.(C)​​No.34749/2025​

    ​the​​submissions​​of​​the​​learned​​counsels,​​we​​find​​that​​the​​temple​​is​​situated​​on​

    ​the​​top​​of​​a​​small​​hill.​ ​The​​’Nalambalam’​​and​​’Chuttambalam’​​of​​the​​temple​​are​

    ​located​ ​in​ ​an​ ​inner​ ​square,​ ​well​ ​demarcated​ ​by​ ​a​ ​compound​ ​wall​ ​on​ ​all​ ​four​

    ​sides​​having​​a​​height​​of​​about​​12​​feet.​ ​Four​​Gopurams​​are​​also​​built​​on​​all​​four​

    ​sides​​of​​the​​inner​​square.​ ​The​​extent​​of​​the​​inner​​square​​wherein​​the​​temple,​

    ​the main deity, and the sub-deities are located is having an extent of 9.5 Acres.​

    ​31.​ ​The​ ​daily​ ​poojas​ ​and​ ​rituals​ ​of​ ​the​ ​said​ ​temple​​are​​conducted​​in​

    ​the​ ​inner​​square​​of​​the​​temple.​ ​However,​​during​​the​​Pooram​​festival,​​which​​is​

    ​organised​ ​during​ ​April​ ​-​ ​May​ ​and​ ​during​ ​Sivarathri​ ​and​ ​other​​festival​​seasons,​

    ​the​ ​entire​ ​Kshethra​ ​Maidan​ ​is​ ​also​ ​used​ ​for​ ​various​ ​religious​ ​activities.​ ​The​

    ​outer​​circle,​​which​​surrounds​​the​​temple,​​has​​an​​extent​​of​​59​​Acres.​ ​Above​​the​

    ​outer​​circle,​​there​​is​​another​​circle,​​which​​is​​called​​’Swaraj​​Round’,​​which​​is​​one​

    ​of the most important roads in Thrissur City.​

    ​32.​ ​We​ ​have​ ​carefully​ ​considered​ ​the​ ​pleadings,​ ​materials​ ​placed​ ​on​

    ​record, and the submissions made in the court.​

    ​33.​ ​The​ ​crucial​ ​question​ ​involved​ ​in​ ​this​ ​case​ ​is​ ​whether​ ​the​

    ​Vadakkumnatha​ ​Kshethra​ ​Maidan​ ​can​ ​be​ ​put​ ​to​ ​any​ ​use​ ​other​ ​than​ ​religious​

    ​purposes and for the performance of the customary rites and rituals?​

    ​34.​ ​The​ ​learned​ ​Standing​ ​Counsel​ ​for​ ​the​ ​Cochin​ ​Devaswom​ ​Board​

    ​would​ ​submit​ ​that​ ​if​ ​the​ ​outer​ ​circle​ ​of​ ​the​ ​Kshethra​ ​Maidan​ ​is​ ​put​ ​to​ ​some​

    ​other​ ​uses,​ ​such​ ​as​ ​for​ ​the​ ​conduct​ ​of​ ​cultural​ ​events,​ ​sports​ ​events,​ ​and​

    ​political​​events,​​the​​Board​​may​​be​​able​​to​​enhance​​its​​income​​to​​a​​great​​extent.​

    ​The​ ​additional​ ​income​ ​so​ ​generated​ ​could​ ​very​ ​well​ ​be​ ​used​ ​for​ ​the​

    ​development of the temple and the welfare of the devotees.​

    ​35.​ ​However,​ ​the​ ​learned​ ​counsels​ ​appearing​ ​for​ ​the​ ​writ​ ​petitioners​

    ​would​​submit​​that​​the​​Kshethra​​Maidan​​could​​be​​permitted​​to​​be​​used​​only​​for​

    ​religious activities.​

    ​36.​ ​We​​have​​carefully​​gone​​through​​the​​orders​​and​​judgments​​passed​

    ​by this Court from time to time.​

    ​37.​ ​By​​Annexure​​A2​​order​​dated​​16.03.1990,​​this​​Court​​permitted​​the​

    ​Cochin​​Devaswom​​Board​​to​​grant​​a​​temporary​​licence​​or​​lease​​for​​the​​conduct​

    ​of​ ​seasonal​ ​business​ ​like​ ​the​ ​sale​ ​of​ ​watermelons​ ​and​ ​to​ ​conduct​ ​exhibitions​

    ​during the Pooram festival.​

    ​38.​ ​As​ ​per​ ​Annexure​ ​A3​ ​judgment​ ​dated​ ​28.03.2003,​ ​this​ ​Court​

    ​permitted​​the​​Board​​to​​use​​the​​Maidan​​for​​the​​purposes​​mentioned​​in​​Annexure​

    ​R2(a)​​in​​O.P.​​No.8521​​of​​2003.​ ​In​​that​​judgment,​​this​​Court​​made​​it​​clear​​that​

    ​the​ ​Maidan​ ​could​ ​be​ ​put​ ​to​ ​any​ ​use​ ​which​ ​will​ ​not​ ​affect​ ​the​ ​sentiments​ ​of​

    ​Hindu​​devotees.​ ​The​​uses​​for​​which​​the​​Maidan​​could​​be​​let​​out​​are​​extracted​

    ​in​ ​the​ ​foregoing​ ​paragraphs​ ​of​ ​this​ ​judgment.​ ​As​ ​many​ ​as​ ​twelve​ ​purposes​

    ​were stated in Annexure R2(a).​

    ​39.​ ​In​​Annexure​​A4​​and​​in​​Annexure​​A5​​orders​​in​​DBP​​No.48​​of​​2010,​

    ​this​​Court​​has​​interdicted​​permanent​​construction​​in​​the​​Maidan.​ ​Furthermore,​

    ​this Court issued directions for the afforestation activities in the Maidan.​

    ​40.​ ​In​ ​Annexure​ ​A6​ ​order​ ​dated​ ​30.09.2013​ ​in​ ​DBP​ ​No.78​ ​of​ ​2013,​

    ​this​​Court​​reiterated​​the​​directives​​issued​​in​​DBP​​No.48​​of​​2010.​ ​This​​Court​​has​

    ​turned​ ​down​ ​the​ ​request​ ​of​ ​the​ ​Board​ ​to​ ​use​ ​the​ ​Maidan​ ​for​ ​purposes​ ​other​

    ​than those stated in the Annexure A3 judgment.​

    ​41.​ ​However,​ ​vide​ ​Annexure​ ​A8​ ​order​ ​in​ ​DBP​ ​No.31​ ​of​ ​2022,​ ​a​

    ​Coordinate​ ​Bench​ ​of​ ​this​ ​Court​ ​permitted​ ​the​ ​Board​ ​to​ ​conduct​

    ​exhibitions/trade​ ​fairs​ ​in​ ​the​ ​Pooram​ ​Exhibition​ ​ground​​for​​that​​particular​​year​

    ​to​ ​support​ ​the​ ​Board,​ ​which​ ​was​ ​facing​ ​an​ ​acute​ ​financial​ ​crisis​ ​during​ ​the​

    ​COVID-19 pandemic period.​

    ​42.​ ​By​ ​Annexure​ ​A9​ ​judgment,​ ​this​ ​Court​ ​interdicted​ ​the​ ​installation​

    ​of​​hoardings,​​advertisement​​boards,​​etc.,​​in​​the​​Maidan​​and​​also​​the​​erection​​of​

    ​temporary structures so as to block the right of the pedestrians.​

    ​45.​ ​The​ ​principal​ ​contention​ ​of​ ​the​ ​learned​ ​Standing​ ​Counsel​​for​​the​

    ​Board​​is​​that​​the​​Kshethra​​Maidan,​​which​​is​​located​​in​​the​​heart​​of​​Thrissur​​City,​

    ​could​ ​be​ ​more​ ​effectively​ ​used​ ​by​ ​letting​ ​it​ ​out​ ​temporarily​ ​for​ ​some​

    ​non-religious​ ​purposes​ ​so​ ​as​ ​to​ ​augment​ ​the​​income​​of​​the​​Board.​ ​According​

    ​to​​the​​learned​​counsel,​​there​​is​​no​​point​​in​​keeping​​the​​huge​​extent​​of​​property​

    ​idle​ ​in​ ​an​ ​unproductive​ ​manner,​ ​particularly​ ​when​​the​​Board​​is​​facing​​financial​

    ​constraints.​

    ​46.​ ​The​ ​learned​ ​counsels​ ​for​ ​the​ ​writ​ ​petitioners​ ​had​ ​expressed​ ​the​

    ​anxiety​ ​of​ ​the​ ​devotees​ ​that​ ​the​ ​commercialisation​​and​​the​​use​​of​​the​​Maidan​

    ​for political and cultural activities would destroy its sanctity and purity.​

    ​47.​ ​Having​ ​considered​ ​the​ ​rival​ ​submissions,​​we​​are​​of​​the​​view​​that​

    ​the​​Court​​has​​to​​strike​​a​​balance​​between​​the​​conflicting​​interests​​of​​the​​Board​

    ​and​ ​the​ ​devotees.​ ​This​ ​Court​ ​cannot​ ​turn​ ​down​ ​or​ ​reject​ ​the​ ​reasonable​

    ​request​ ​of​ ​the​ ​Board​ ​to​ ​augment​ ​or​ ​increase​ ​their​ ​income,​ ​as​ ​the​ ​ultimate​

    ​beneficiaries are the deity and devotees themselves.​

    ​48.​ ​At​ ​the​ ​same​ ​time,​ ​this​ ​Court​ ​is​ ​conscious​ ​of​ ​the​ ​religious​

    ​sentiments, apprehensions, and anxieties of the devotees.​

    ​49.​ ​From​ ​the​​submissions​​of​​the​​learned​​counsels,​​it​​appears​​that,​​in​

    ​many​​cases,​​the​​immovable​​properties​​owned​​by​​the​​temples​​are​​kept​​idle​​and​

    ​unutilised.​ ​No​ ​doubt,​ ​the​ ​landed​ ​properties​ ​and​ ​the​ ​buildings​ ​are​ ​one​ ​of​ ​the​

    ​major​ ​assets​​of​​the​​temples​​under​​the​​management​​of​​the​​Devaswom​​Boards.​

    ​If​​the​​whole,​​or​​at​​least​​a​​part​​of​​the​​immovable​​properties​​are​​let​​out​​for​​some​

    ​events​ ​and​ ​programmes,​ ​the​ ​Board​ ​may​ ​generate​​or​​augment​​its​​income​​to​​a​

    ​great extent.​

    ​50.​ ​We​ ​have​ ​anxiously​ ​gone​ ​through​ ​Annexures​ ​A19​ ​and​ ​A20​

    ​documents.​ ​In​ ​Annexure​ ​A19,​ ​Column​ ​No.1​​is​​the​​specific​​locations​​identified​

    ​distinctly,​ ​which​ ​could​ ​be​ ​used​ ​in​ ​a​ ​more​ ​productive​ ​manner.​ ​The​ ​entries​ ​in​

    ​Column​ ​No.2​ ​are​ ​the​ ​uses​ ​permitted​ ​by​ ​this​ ​Court​​by​​Annexure​​A3​​judgment.​

    ​The entries in Column No.3 are the new proposals submitted by the Board.​

    ​51.​ ​On​ ​going​ ​through​ ​the​ ​new​ ​proposal,​ ​we​ ​are​ ​of​ ​the​ ​considered​

    ​opinion​ ​that​ ​the​ ​temple​ ​ground​ ​shall​ ​not​ ​be​ ​permitted​ ​to​ ​be​ ​used​ ​by​ ​any​

    ​political​ ​party​ ​for​ ​their​ ​protests​ ​and​ ​gatherings.​ ​This​ ​Court​ ​in​ ​N​ ​Prakash​​V.​

    ​The​ ​Travancore​ ​Devaswom​ ​Board​ ​and​ ​others​​2​​,​ ​had​​occasion​​to​​consider​

    ​this​ ​issue.​ ​The​ ​relevant​ ​paragraphs​ ​of​ ​N​ ​Prakash​ ​(supra)​ ​are​ ​extracted​

    ​below :​

    “​ 11.​ ​Before​ ​proceeding​ ​further,​ ​it​ ​would​ ​be​ ​useful​ ​to​ ​refer​ ​to​
    ​various​ ​provisions​ ​of​ ​the​​Religious​​Institutions​​(Prevention​​of​​Misuse)​​Act,​
    ​1988,​​Act​​No.41​​of​​1988​​(hereinafter​​referred​​to​​as​​’the​​Act’).​​The​​object​​of​
    ​the​ ​Act​ ​is​ ​to​ ​prevent​ ​the​ ​misuse​ ​of​ ​religious​ ​institutions​ ​for​ ​political​ ​and​
    ​other purposes.​

    ​ 2.​
    1 ​Section​​3​​of​​the​​Act​​states​​that​​a​​religious​​institution​​or​​its​
    ​manager​ ​shall​ ​not​ ​use​ ​or​ ​allow​ ​the​ ​use​​of​​its​​premises​​for​​the​​promotion​
    ​and propagation of any political activities. Section 3 of the Act reads thus:​

    ​”3.​​Prohibition​​of​​use​​of​​religious​​institutions​​for​​certain​
    ​purposes.–​
    ​No​ ​religious​ ​institution​ ​or​ ​manager​ ​thereof​ ​shall​ ​use​ ​or​
    ​allow​​the​​use​​of​​any​​premises​​belonging​​to,​​or​​under​​the​​control​​of,​
    ​the institution–​

    ​(a)​ ​for​ ​the​ ​promotion​ ​or​ ​propagation​ ​of​ ​any​ ​political​
    ​activity; or​

    ​(b)​ ​for​ ​the​ ​harbouring​ ​of​ ​any​​person​​accused​​or​​convicted​
    ​of an offence under any law for the time being in force; or​

    ​(c) for the storing of any arms or ammunition; or​

    ​(d)​​for​​keeping​​any​​goods​​or​​articles​​in​​contravention​​of​​any​
    ​law for the time being in force; or​

    ​(e)​ ​for​ ​erecting​ ​or​ ​putting​ ​up​ ​of​ ​any​ ​construction​ ​or​
    f​ortification,​ ​including​ ​basements,​ ​bunkers,​​towers​​or​​walls​​without​
    ​a​ ​valid​ ​licence​ ​or​ ​permission​ ​under​ ​any​ ​law​ ​for​ ​the​ ​time​ ​being​ ​in​
    ​force; or​

    ​(f)​ ​for​ ​the​ ​carrying​ ​on​ ​of​ ​any​ ​unlawful​ ​or​ ​subversive​ ​act​
    ​ rohibited​ ​under​ ​any​ ​law​ ​for​ ​the​ ​time​ ​being​ ​in​ ​force​ ​or​ ​in​

    ​(h)​ ​for​ ​the​ ​carrying​ ​on​ ​of​ ​any​ ​activity​ ​prejudicial​ ​to​ ​the​
    ​sovereignty, unity and integrity of India; or​

    ​(i)​ ​for​ ​the​ ​doing​ ​of​ ​any​ ​act​ ​in​ ​contravention​ ​of​ ​the​
    ​ rovisions​​of​​the​​Prevention​​of​​Insults​​to​​National​​Honour​​Act,​​1971​

    ​13.​ ​Section​ ​5​ ​of​ ​the​ ​Act​ ​prohibits​ ​the​ ​use​ ​of​ ​funds​ ​of​ ​religious​
    i​nstitutions​​for​​the​​benefit​​of​​any​​political​​party.​ ​Further,​​Section​​6​​of​​the​
    ​Act​​prohibits​​that​​a​​religious​​institution​​or​​manager​​thereof​​shall​​not​​allow​
    ​any​ ​ceremony,​ ​festival,​ ​congregation,​ ​procession​ ​etc.​ ​organised​ ​or​ ​held​
    ​under​​its​​auspices​​to​​be​​used​​for​​any​​political​​activity.​​Section​​7​​of​​the​​Act​
    ​imposes penalties for the violation of Sections 3, 4, 5 and 6.​

    ​14.​ ​Section​ ​2​ ​of​ ​the​ ​Act​ ​defines​ ​the​ ​term​ ​’political​ ​activity’,​ ​’political​
    ​ arty’ and ‘religious institution’.​

    “​ (d)​​”political​​activity”​​includes​​any​​activity​​promoting​​or​​propagating​​the​
    ​aims​ ​or​ ​objects​ ​of​ ​a​ ​political​ ​party​ ​or​ ​any​ ​cause,​ ​issue​ ​or​ ​question​ ​of​ ​a​
    ​political​ ​nature​ ​by​ ​organising​ ​meetings,​ ​demonstrations,​ ​processions,​
    ​collection​ ​or​ ​disbursement​ ​of​ ​funds,​ ​or​ ​by​ ​the​ ​issue​ ​of​ ​directions​ ​or​
    ​decrees,​ ​or​ ​by​ ​any​ ​other​​means,​​and​​includes​​also​​such​​activity​​by​​or​​on​
    ​behalf​ ​of​ ​a​ ​person​ ​seeking​ ​election​ ​as​ ​a​ ​candidate​ ​for​ ​any​ ​election​ ​to​
    ​Parliament, any State Legislature or any local authority;​

    ​(e) “political party” means an association or body of persons–​
    ​(i)​ ​which​ ​is,​ ​or​ ​is​ ​deemed​ ​to​ ​be,​ ​registered,​ ​with​ ​the​ ​Election​
    ​Commission​ ​of​ ​India​ ​as​ ​a​ ​political​ ​party​ ​under​ ​the​ ​Election​ ​Symbols​
    ​(Reservation and Allotment) Order, 1968, as in force for the time being; or​
    ​(ii)​​which​​has​​set​​up​​candidates​​for​​election​​to​​any​​legislature,​​but​
    ​is​ ​not​ ​registered,​ ​or​ ​deemed​ ​to​ ​be​ ​registered,​ ​as​ ​a​ ​political​ ​party,​​under​
    ​the Election Symbols (Reservation and Allotment) Order, 1968; or​
    ​(iii)​ ​organised​ ​to​ ​carry​ ​on​ ​any​ ​political​ ​activity​ ​or​ ​to​ ​acquire​ ​or​
    ​exercise political power through election or otherwise;​

    ​(f)​ ​”religious​ ​institution”​ ​means​ ​an​ ​institution​ ​for​ ​the​ ​promotion​ ​of​ ​any​

    ​represents its pride, identity and unity.​

    ​ 6.​
    1 ​There​​cannot​​be​​any​​doubt​​that​​Section​​3​​of​​the​​Act​​prohibits​​the​
    ​use​ ​of​ ​the​ ​religious​ ​institutions​ ​or​ ​its​ ​premises​ ​for​ ​propagation​ ​and​
    ​promotion​ ​of​ ​political​ ​activities.​ ​Section​ ​7​ ​of​ ​the​ ​Act​ ​also​ ​provides​ ​the​
    ​penalty​​for​​the​​violation​​of​​Sections​​3,​​4,​​5,​​and​​6​​of​​the​​Act.​​This​​Court​​in​
    ​Hindu​ ​Seva​ ​Kendram​ ​(supra)​ ​and​ ​Sinilkumar​ ​E.​ ​K.​ ​(supra),​ ​made​ ​it​
    ​clear​​that​​politics​​has​​no​​role​​to​​play​​in​​temples.​​This​​Court​​reiterated​​the​
    ​same​ ​principle​​in​​Major​​Vellayani​​Devi​​Temple​​Advisory​​Committee​

    ​53.​ ​Annexure​​A19​​proposal​​would​​seek​​permission​​for​​the​​conduct​​of​

    ​all​ ​cultural​ ​events​ ​of​ ​all​ ​the​ ​departments​ ​and​ ​the​ ​parking​ ​of​ ​the​ ​vehicles​ ​in​

    ​connection with the programs.​

    ​54.​ ​Insofar​​as​​this​​request​​is​​concerned,​​we​​are​​of​​the​​firm​​view​​that​

    ​the​​events​​and​​programs​​of​​all​​departments​​of​​the​​State​​Government​​cannot​​be​

    ​permitted​ ​in​ ​the​ ​Kshethra​ ​Maidan.​ ​The​ ​Board​ ​may​ ​grant​ ​permission​ ​to​ ​the​

    ​events​​related​​to​​the​​Devaswom​​Department​​and​​the​​programs​​of​​the​​temples​

    ​under​ ​the​ ​control​ ​of​ ​various​ ​Devaswom​ ​Boards​ ​without​ ​accepting​ ​any​ ​licence​

    ​fee/rent.​ ​If​​the​​Maidan​​is​​let​​out​​to​​the​​programmes/events​​conducted​​by​​the​

    ​other​ ​Departments,​ ​the​ ​Board​ ​may​ ​ensure​ ​sufficient​ ​licence​ ​fee/rent​​from​​the​

    ​other​ ​Departments.​ ​Permission​ ​was​ ​also​ ​sought​ ​by​ ​the​ ​Board​ ​to​ ​conduct​

    ​cultural​​events​​in​​the​​Maidan.​ ​The​​term​​’cultural​​programs’​​is​​too​​wide,​​elastic​

    ​and​ ​capable​ ​of​ ​being​ ​interpreted​ ​in​ ​different​ ​ways.​ ​Insofar​​as​​the​​conduct​​of​

    ​cultural​​events​​is​​concerned,​​it​​is​​for​​the​​Board​​to​​take​​an​​appropriate​​decision​

    ​to​ ​exercise​ ​the​ ​discretion​ ​vested​ ​with​ ​it​ ​in​ ​a​ ​prudent​​manner,​​so​​as​​to​​ensure​

    ​that​ ​the​ ​purity​ ​and​ ​sanctity​ ​of​ ​the​ ​temples​ ​are​ ​protected​ ​and​ ​the​ ​interests​​of​

    ​the​ ​devotees​ ​are​ ​unaffected.​ ​On​ ​this​ ​issue,​ ​this​ ​Court​ ​cannot​ ​fix​ ​a​

    ​straightjacket formula as to which events should be permitted in the Maidan.​

    ​55.​ ​It​ ​is​ ​made​ ​clear​ ​that​ ​the​ ​remaining​ ​part​ ​of​ ​the​ ​proposal​ ​is​

    ​accepted​ ​by​ ​this​ ​Court,​ ​and​ ​the​ ​Board​ ​can​ ​give​ ​permission​​to​​the​​prospective​

    ​organisers​ ​with​ ​stringent​ ​conditions​ ​after​ ​ensuring​ ​fair​ ​returns​ ​in​ ​the​ ​form​ ​of​

    ​licence​​fee/rent.​ ​It​​is​​made​​clear​​that​​henceforth,​​the​​Board​​need​​not​​approach​

    ​this​ ​Court​ ​seeking​ ​permission​ ​for​ ​any​ ​of​ ​the​ ​programs​ ​or​ ​events​ ​as​ ​stated​ ​in​

    ​Annexures​ ​A19​ ​and​ ​A20,​ ​other​ ​than​ ​those​ ​events​ ​to​ ​which​ ​permission​ ​is​

    ​declined​​by this Court​​.​

    ​56.​ ​However,​ ​we​ ​reiterate​ ​that​ ​no​ ​permanent​ ​or​ ​semi-permanent​

    ​constructions​ ​shall​ ​be​ ​made​ ​in​ ​the​​Kshethra​​Maidan​​without​​previous​​sanction​

    ​from​​this​​Court.​ ​So​​also,​​no​​proposal​​for​​beautification​​be​​permitted​​to​​be​​done​

    ​without previous sanction from this Court.​

    ​57.​ ​We,​​further​​direct​​that​​the​​licence​​agreement/lease​​agreement​​to​

    ​be​ ​executed​ ​between​ ​the​ ​Board​​and​​the​​prospective​​organisers​​shall​​inter​​alia​

    ​contain the following conditions :​

    ​(i)​ ​strict​ ​prohibition​ ​on​ ​littering,​ ​waste​ ​accumulation,​ ​sale​ ​and​
    ​consumption​​of​​non-vegetarian​​food​​and​​the​​disposal​​of​​any​​material​
    ​within the temple premises;​

    ​(ii)​​mandatory​​installation​​of​​adequate​​waste​​bins​​and​​arrangements​
    ​for prompt waste removal;​

    ​(iii)​ ​measures​ ​to​ ​prevent​ ​water​ ​pollution,​ ​soil​ ​contamination,​ ​and​
    ​damage to vegetation or temple property;​

    ​(iv)​ ​stringent​ ​control​ ​of​ ​sound​ ​levels,​ ​ensuring​ ​that​ ​loudspeakers,​
    ​amplifiers,​ ​or​ ​musical​ ​instruments​ ​do​ ​not​ ​cause​ ​sound​ ​pollution​ ​or​
    ​disturb​ ​devotees​ ​or​ ​nearby​ ​residents,​ ​and​ ​that​ ​permissible​ ​decibel​
    ​limits are adhered to;​

    ​(v)​ ​prohibition​ ​on​ ​the​ ​use​ ​of​ ​plastics,​ ​flex​ ​boards,​ ​or​ ​any​
    ​non-biodegradable materials;​

    ​(vi)​ ​restrictions​ ​on​ ​cooking,​ ​storage​ ​of​ ​combustibles,​ ​or​ ​erection​ ​of​
    ​temporary structures except as permitted; and​

    ​(vii)​ ​the​ ​responsibility​ ​of​ ​the​ ​organisers​ ​to​ ​restore​ ​the​ ​area​ ​to​ ​its​
    ​original clean condition immediately after the event.​

    ​(viii) Total prohibition on erecting any permanent structures.​

    ​58.​ ​After​​a​​careful​​consideration​​of​​the​​pleadings,​​materials​​placed​

    ​on​ ​record​ ​and​ ​the​ ​submissions​ ​advanced​ ​in​ ​the​ ​Court,​ ​we​ ​deem​ ​it​

    ​appropriate to dispose of these matters with the following directions :-​

    ​(1)​ ​DBA​​No.9​​of​​2025​​is​​disposed​​of​​permitting​​the​​Cochin​​Devaswom​

    ​Board​ ​to​ ​let​ ​out​ ​the​ ​Kshethra​ ​Maidan​ ​for​ ​the​ ​purposes​ ​stated​​in​

    ​Annexures-A18​ ​and​ ​A19,​ ​subject​ ​to​ ​restrictions​ ​and​ ​limitations​

    ​imposed by this Court in the foregoing paragraphs.​

    ​(2)​ ​Subject​ ​to​ ​(1)​ ​above,​ ​no​ ​event​ ​or​ ​programme,​ ​whatsoever,​​shall​

    ​be​ ​held/conducted​ ​in​ ​the​ ​Kshethra​ ​Maidan​ ​without​ ​prior​ ​written​
