The petitioners have filed this petition under
Section 166 of Motor Vehicles Act, 1988, claiming
compensation of Rs.75,00,000/- for the death of
Darshan V. in a road traffic accident.
The brief facts of the petitioners case is as
under:
2. That, on 11.09.2024 at about 10.15 p.m. the
deceased was riding the motor cycle bearing No.KA-
47-K-3809, near Madurai Idly Hotel, on Inner Ring
Road, Domlur, Bengaluru, slowly, cautiously and
carefully by observing all the traffic rules and
regulations, at that time, driver of Tipper Lorry
bearing registration No.KA-51-AG-4250 drove the
same in a rash and negligent manner and dashed
against the deceased motor cycle. Due to the
tremendous impact, the deceased fell down and
sustained multiple injuries all over the body.
Immediately he was shifted to Lady Curzen Hospital,
after first aid treatment, he was shifted to Victoria
Hospital, Bengaluru, wherein he admitted as an
inpatient, Inspite of best treatment, Darshan M.V.
was succumbed to the injuries in the said hospital on
12.09.2024. Thereafter, post mortem was conducted
and the body was handed over to the petitioners. The
petitioners have spent huge amount towards
transportation of dead body, funeral and obsequies
ceremony of the deceased.
