UPON hearing the counsel the Court made the following
O R D E R
1. The present Special Leave Petition has been filed
challenging the order dated 02.03.2026 passed by the Himachal
Pradesh High Court dismissing the regular Bail Application of
the petitioner-accused, who has been charged with possession of
29.84 grams of Heroin under Narcotic Drugs and Psychotropic
Substances Act (for short “NDPS Act”).

Keeping in view the five criminal antecedents of the

Reason:
petitioner, this Court is of the view that he is not entitled

to bail on merits.
3. At this stage, learned counsel for the petitioner presses
I.A. No.180806/2026, praying for admission in a Government
Recognised De-addiction/ Rehabilitation Centre so that
Petitioner can undergo treatment, counselling and
rehabilitation in accordance with law.
4. The said prayer(s) has been opposed by the Respondent-
State by filing a reply on the ground that the benefit of
Section 64A of the NDPS Act is not intended to give protection
to persons involved in illegal possession or trafficking of
Narcotics substances like Chitta/Heroin. According to the
Respondent-State, the benefit of Section 64A can be availed
only by a consumer of narcotics charged under Section 27 of the
NDPS Act or with offences involving possession of small
quantity of narcotic drugs.
5. This Court finds that in the present case the Petitioner
is charged not under Section 27 of NDPS Act, but under Section
21 of the NDPS Act and that too for possession of intermediate
quantity of narcotic substances. In any event, this Court find
that there is no medical record from jail authority (despite
the Petitioner having been in custody for more than ten months)
to show that the Petitioner is a drug addict requiring
rehabilitation or that he is suffering from withdrawal
symptoms.

6. Accordingly, the present Special Leave Petition is
dismissed along with all pending applications.
