1. Leave granted.
2. The appellant has been arraigned as the sole accused for
the offences punishable under Sections 376, 376-E and 506
of the Indian Penal Code, 1860 (for short, the ‘IPC’) read
with Section 67-A of the Information Technology Act, 2000
(for short, the ‘IT Act’). Respondent No.2 – prosecutrix,
who has been issued notice, has chosen not to appear
before this Court.
3. The case of the prosecution against the appellant is that
he had repeatedly committed the offence of rape upon the
respondent No.2 – prosecutrix. Apart from committing the
offence of rape, he also extended threats to the
prosecutrix. The incidental charge is that he threatened
to release the obscene video of committing the offence of
rape as aforestated.
