2. The appellant has been arraigned as an

SPONSORED

accused in Case Crime No.106/2024 for committing

offences punishable under Section 498-A, 304-B of

the Indian Penal Code, 1860 and Sections 3/4 of

the Dowry Prohibition Act, 1961.

3. Appellant is posted as Lekhpal at

Shahjahanpur and married to the deceased on

04.12.2023. The deceased committed suicide at her

matrimonial home at Etawah on 02.06.2024.

4. The appellant is in jail since 21.06.2024.

5. Considering the entire facts and

circumstances of the case particularly, that the

appellant is in jail since 21.06.2024, we are

inclined to release him on bail.

6. Accordingly, the impugned order passed by the

High Court is set aside and it is directed that

during the pendency of the appeal before the High

Court, the sentence imposed upon the appellant

shall remain suspended and he shall be released on

bail in connection with the Case Crime No.106/2024

registered at Police Station – Saifai, District –

Etawah on such terms and conditions as may be

imposed by the Trial Court. However, appellant

shall co-operate in the trial.

7. The Appeal stands allowed in the above stated

terms.

8. Pending applications(s), if any, shall stand

closed.
