Learned senior advocate appearing for the petitioner submits
that petitioner is in custody for 276 days and there is no prospect of
the trial being concluded in near future. Additionally, the materials
which surfaced in course of the evidence including the statement of
the victim under Section 183 of the BNSS and the statement before
the doctor do not inspire confidence for implication of the present
petitioner, as such the petitioner may be released on bail.
Learned advocate appearing for the State on the other hand
opposes the prayer for bail and submits that out of 23 witnesses
cited in the charge-sheet 16 witnesses have been examined.
I have taken into account the evidence of the victim which
has been placed before this Court and on assessment of the same, I

am not inclined to release the petitioner on bail at this stage as the
case is at an advance stage.
Learned trial Court would expedite the process, as it had
been doing, to complete the prosecution witnesses within a
reasonable period of time.
With the aforesaid observations, CRM (M) 2823 of 2025 is
dismissed.
All parties shall act in terms of server copy of the order
downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be
supplied to the parties upon compliance with all requisite
formalities.
