[1] Mr. L. Shashibhushan, learned senior counsel instructed by Mr. Md.

SPONSORED

Fakharuddin, learned counsel for writ petitioner, Mr. Phungyo Zingkhai, learned

State counsel for respondent Nos. 1, 2 & 4 and Mr. W. Darakeshwar, learned

Senior Panel Counsel for Central Government (Sr. PCCG) for respondent No. 3

are before this Court (physical Court).

[2] There are three ‘First Information Reports’ (‘FIR’ in singular for the

sake of brevity) qua detenu (writ petitioner) and the details are as follows:

(i) 1st FIR – FIR No 11 (1) 2025 dated 21.01.2024 on the file

of City Police Station, Imphal West District for alleged

offences under section 20/16 of ‘Unlawful Activities

(Prevention) Act, 1967 (37 of 1967)’ {hereinafter ‘UAPA’ for

the sake of brevity and convenience}.

(ii) 2nd FIR – FIR No. 36 (05) 2025 dated 05.05.2025 on the file

of Heingang Police Station, Imphal East District for alleged

offences under Section 17/20 of UAPA and 25 (1-B) of Arms

Act, 1959 (54 of 1959).

(iii) 3rd FIR – FIR No. 09(01)2026 dated 09.01.2026 on the file

of Lamphel Police Station, Imphal West District for alleged

offences under Section 17/20 of UAPA.

[3] Mr. L. Shashibhushan, learned senior counsel submits on

instructions that as regards 1st FIR, detenu (writ petitioner) is not named in the

same and the detenu was never arrested.

[4] As regards 2nd FIR, detenu was arrested on 05.05.2025 but was

enlarged on bail {regular bail vide order dated 04.08.2025 made in Cril. Misc (B)

Case No. 288 of 2025 on the file of the Court of Special Judge (NIA), Imphal

East}.

[5] As regards 3rd FIR, detenu was arrested on 08.01.2026 and 90 days

therefrom elapsed on 09.04.2026. Mr. L. Shashibhushan, learned senior counsel

submits on instructions that detenu has been granted bail qua 3rd FIR also and

Mr. Md. Fakharuddin, learned counsel for writ petitioner seeks time to produce a

copy of the bail order.

[6] Both sides to get instructions on the following:

(i) As regards 3rd FIR, 90 days therefrom elapsed on

09.04.2026. Has prosecution filed an application for

extension of time for filing final report/extension of remand

under Section 43D(2) of UAPA ?

(ii) Whether bail order (to be produced) qua 3rd FIR is a ‘regular

bail order’ or ‘default bail order’?

(iii) Any other instruction, including instruction regarding

‘unauthorized organization’ notification
