1. The first appeal under section 96 of the Civil Procedure
Code 1908 (for short ‘CPC’) at the behest of plaintiff challenges
the judgment and decree dated 29.11.2002 passed by learned
City Civil Court, Ahmedabad in Civil Suit No. 3877 of 1988 by
which the plaintiff’s suit was dismissed.
