1. By this petition filed under Article 226 of the Constitution of India,

SPONSORED

the petitioner herein has challenged Notice No. ETO/DKR/2026-

27/92-93 dated 21.04.2026 issued by respondent No. 5, by virtue

of which, she has been directed to arrange an alternative premises

and submit the requisite documents for shifting the liquor vend

Lach Khazana, Pyt. Kishtwar, with further direction upon the

respondents to allow her to run liquor vend at Nera Sen Filling

Station, Padder Road, Kishtwar.

2. Learned counsel for the petitioner states that no opportunity of

being heard has been provided to the petitioner before issuance of

the impugned notice.

3. Notice.

4. Ms. Monika Kohli, learned Sr. AAG waives notice on behalf of the

respondents. She seeks and is granted four weeks’ time for filing

reply, with an advance copy to learned counsel for the petitioner.

5. List again on 03.06.2026.

6. Meanwhile, subject to objections from the other side and till next

date of hearing, impugned notice dated 21.04.2026 shall remain

stayed. However, the petitioner is allowed to run/operate her liquor

vend, Lach Khazana, Pyt. Kishtwar from the new location situated

at Nera Sen Filling Station, Padder Road, Kishtwar, subject to

deposit of Minimum Guaranteed Revenue (MGR) as per the Excise

Act and the Rules made thereunder.

7. Alteration/modification/vacation on motion.
