    01. 1. Heard learned counsel for the petitioner and State.

    2. Instant petition has been filed under Section 482 BNSS
    by the petitioner seeking pre-arrest bail in connection with
    Paralakhemundi P.S. Case No.84 of 2019 corresponding to
    G.R. Case No.199 of 2019(A) pending in the file of learned
    S.D.J.M., Gajapati on the grounds stated.

    3. Perused the FIR as at Annexure-1. Recorded the
    submission of Mr. Das, learned counsel for the petitioner and
    State. A case under Sections 399 and 402 IPC has been
    registered along with Sections 4 and 5 of Explosive Substances
    Act. It is informed to the Court by Mr. Lenka, learned ASC that
    the investigation is over and at present NBW/A is pending
    execution against the petitioner. The FIR reveals arrest and
    recovery of incriminating material at the spot. The involvement
    of the petitioner is alleged in the planning to commit dacoity
    along with others having congregated at the spot. Considering

    the allegations therein and antecedents of the petitioner, this
    Court is not inclined to entertain the bail plea, however, grants
    liberty for him to surrender before the learned court below
    seeking regular bail and in case of rejection, to approach the
    Sessions Court for orders pleading parity for its consideration
    on merit.

    4. Accordingly, it is ordered.

    5. In the result, the ABLAPL is disposed of with the
    liberty in favour of the petitioner to surrender before the
    learned S.D.J.M., Gajapati in connection with G.R. Case
    No.199 of 2019(A) corresponding to Paralakhemundi P.S. Case
    No.84 of 2019 within a fortnight from today and on an
    application for bail moved by him, it shall be dealt with as per
    law and disposed of on the same day and in case of rejection, to
    approach the Sessions Court for orders on the same day in
    compliance of the direction issued hereinabove and for the said
    purpose, the lower court record shall be made available at the
    time of hearing.

    6. Issue urgent certified copy of this order as per rules.
