, while she went alongwith her mother to live in her
matrimonial home, they were abused. Dharmendra Choudhary
tried to kill her and Hema Devi sprinkled kerosene oil upon her
and her husband tried to lite the fire, thereafter she and her
mother raised alarm and they were saved by the people
assembled there.
4. It is submitted by learned counsel for the petitioners
that petitioner no. 1 is the elder brother-in-law of the
informant/O.P. No.2, whereas petitioner no.2 is his wife and
petitioner no. 3 is younger brother of the husband of the
informant/O.P. No.2.
5. It is submitted that allegation, as raised against them,
is appearing very much general and omnibus in nature and
moreover, they are living separately. It is submitted that to
harass the entire family members, who have not even otherwise
remotely connected with daily and domestic affairs of the
informant/O.P. No.2 and her husband, were implicated without
Patna High Court CR. MISC. No.5566 of 2019 dt.28-07-2026
having any cogent materials. It is submitted that in such view of
the matter, the impugned order, where the discharge petition of
the petitioners as preferred before the learned trial court was
rejected vide order dated 07.09.2018, is fit to be set-
aside/quashed.
