1. This petition came to be preferred by the Union
Territory of J&K through SHO Police Station Litter,
Pulwama challenging an order dated 14.08.2025
passed by the Court of learned Principal Sessions
Judge, Pulwama thereby granting bail to an undertrial
that is the respondent-Moomin Abass Dar booked for
alleged commission of offences in FIR No. 14/2024
under sections 363, 366 and 376 of the Indian Penal
Code and section 4 of the Protection of Children from
Sexual Offences (POCSO) Act, 2012.
2. In terms of order dated 16.12.2025, this Court
directed issuance of notice to the respondent, in
response whereof, on 20.02.2026 Advocate Asif Nabi,
came to cause appearance and sought time to file
Vakalatnama as well as reply/objections to the
petition.
