Present Mr. H.S. Paonam, learned senior counsel assisted by Mr. N.

SPONSORED

Bipin, learned counsel and Ms. Malemleima H., learned counsel for the

petitioner; Mr. Niranjan Sanasam, learned Government Advocate for the

State respondents through video conferencing; and Mr. Kh. Tarunkumar,

learned senior counsel assisted by Ms. Kh. Maria, learned counsel for the

private respondent in WP(C) No. 724 of 2015 and WP(C) No. 888 of 2017.

During the course of hearing, it is found in WP(C) No. 651 of 2015

that the petitioner is challenging the allotment order dated 04-02-2015 to the

Director of Commerce & Industries, Manipur for a total area of 44.6224 acres

of land of Village No. 91(A)-Lamphelpat and Village No. 92-Iroisemba. The

Government of Manipur issued an allotment order dated 07-06-1996 to the

petitioner for an area of 6.00 acres of land under C.S. Dag No. 1014 and

1062 (pt) of Revenue Village No. 91(A)-Lamphelpat and vide another

allotment order dated 03-08-1996, the Government of Manipur allotted an

area of 4.00 acres of land under C.S. Dag No. 1014 and 1062 (pt) of

Revenue Village No. 91(A)-Lamphelpat to the petitioner. Dag No. 1062 is

not included as one of the dags for allotment to the Director of Commerce &

Industries, Manipur vide allotment order dated 04-02-2015. However, in the

area of encroachment sought under Dag No. 1063, the petitioner, N.R.

College, is shown as encroacher.

In the counter affidavit filed by State respondent Nos. 1, 2 & 3, it is

not stated that the part of the land to the petitioner by two allotment orders

are not included in the allotment given to the Director, Commerce &

Industries, Manipur vide allotment order dated 04-02-2015. In the

circumstances, the State respondents are directed to clarify as to whether

the land allotted to the petitioner by two allotment orders dated 07-06-1996

and 03-08-1996 are included in the allotment made to the Director of

Commerce & Industries, Manipur by allotment order dated 04-02-2015. The

State respondents are also directed to clarify about the premium fixed for

the land allotted to the petitioner and adjoining land at the relevant times in

terms of the earlier order.

List these cases on 21-04-2026.

Earlier interim order is extended till the next date.
