Today, the present matter has been notified at 02:15
PM on the basis of mentioning slip filed on behalf of the
petitioners for urgent hearing of the case.
2. Learned counsel for the petitioners submits that on
the basis of complaint petition, Bachhawara P.S. Case No. 138
of 2022 was registered under Sections 147, 148, 307, 354, 504
of the IPC against the petitioners and others and after
Patna High Court CR. MISC. No.32097 of 2025(2) dt.28-07-2026

completion of investigation, final form has been submitted
against the petitioners whereas charge sheet has been submitted
under Sections 341, 323, 307, 354, 504 of the IPC against four
accused persons, namely, Vipin Rai, Vikas Kumar, Gulshan
Kumar and Ram Udesh Rai but the learned trial court differing
from the opinion of investigating officer took cognizance under
Sections 341, 323, 307, 354, 504 of the IPC against ten accused
persons including the petitioners without taking into account the
materials available on record.
3. Call for legible photostat copy of the case diary and
statement of victim recorded under Section 164 of Cr.P.C., if
any, in connection with Bachhawara P.S. Case No. 138 of 2022
from the court of learned Chief Judicial Magistrate,
Begusarai/concerned court.
4. Issue notice to the informant by registered post with
A/D as well as by ordinary process, on steps being taken by the
petitioners for filing requisites etc., within a period of two
weeks.
5. Re-list this matter on 15.09.2026.
6. In the meantime, further proceeding in connection
with Bachhawara P.S. Case No. 138 of 2022 pending in the
court of learned Chief Judicial Magistrate, Begusarai/concerned
Patna High Court CR. MISC. No.32097 of 2025(2) dt.28-07-2026

court shall remain stayed till further order of this court.
