File taken up today on account of 03.03.2026 being declared holiday.
1. The accused/applicant seeks regular bail in case FIR No. 1029/2023
of PS Samaipur Badli for offence under Section 376/354/354A IPC and
Section 6 of POCSO Act.
2. Learned counsel for accused/applicant seeks adjournment on the
ground that arguing senior counsel, Mr. Pramod Kr. Dubey is unwell.
Keeping in mind the extreme old pendency of this bail application, which
formed part of 179 such old applications transferred from different benches
to this bench, there is no scope for any adjournment. On this, learned
counsel for accused/applicant seeks a passover to ask the arguing senior
counsel, Mr. Pramod Kr. Dubey to appear through videoconferencing.

4. In the midst of the board, the matter has been taken up on being
mentioned by Mr. Pramod Kr. Dubey, Senior Advocate, who has appeared
through videoconferencing to submit that he is completely hale and hearty
and that it is the briefing counsel, present in court who had specifically
instructed the senior advocate not to appear today.
5. It is extremely unfortunate that a false statement was made at bar.
Learned counsel for accused/applicant expresses apology.
6. Learned counsel for accused/applicant seeks permission to withdraw
this bail application.
7. As requested, the bail application is dismissed as withdrawn.
