1. Feeling aggrieved by and dissatisfied with the

judgment and order of acquittal dated 26.03.2013, passed by

the learned Sessions Judge, Amreli, in Sessions Case No.21

of 2011, for the offences punishable under Sections 498(A),

306 and 114 of the Indian Penal Code, the appellant – State

of Gujarat has preferred this appeal under Section 378 of the

Code of Criminal Procedure, 1973 (for short, “the Code”).

2. The prosecution case as unfolded during the trial

before the Sessions Court, in a nutshell, is that the

complainant – Rambhai Mulabhai Sondarava filed a complaint

to the effect that the marriage of his daughter viz.,

Shilpaben (deceased) was solemnized with accused No.2 –

Mehulkumar Dudabhai Baraiya on 12.12.2008; accused No.1 –
