THE COURT: After hearing the parties, I find that there are three
applications pending in the suit.
The first in order of time is the plaintiff’s application for injunction
wherein by an order dated 15th January, 2026 the Co-ordinate Bench has
recorded the submission made on behalf of the respondent that save and
except the existing stock supplied by the plaintiff to the defendant being its
dealer, the defendant is not interested in selling any of the products of the
plaintiff. The dealership agreement has been terminated and, as such, there is
no question of any fresh supply of stocks. The second application in order of
time is the defendant’s application for disclosure of additional documents. The
third application is the defendant’s application under Sections 5 and 8 of the
Arbitration and Conciliation Act, 1996.
Since the three applications are required to be heard either
simultaneously or analogously, the matters are adjourned and shall appear in
the monthly list of May 2026.
