This Writ Petition, filed under Article 226 of the Constitution
of India, seeks the following relief:
“…to issue an appropriate writ, order or direction, more
particularly one in the nature of Writ of Mandamus
declaring the Land Acquisition proceedings initiated for
submergence of Mid-Manair Reservoir Project in the
limits of Cheerlavancha Village, erstwhile Sircilla
Mandal, now Thangallapalli Mandal, vide Draft
Notification No.D3/2876/2007-1 dated 19.09.2007 and
Draft Declaration No.D3/2876/2007-2 dated
20.09.2007 as illegal, arbitrary, void and lapsed in view
of Section 24(2) of the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013, being violative of the provisions
of the Land Acquisition Act, 1894, the principles of
natural justice and Articles 14, 19 and 300-A of the
Constitution of India, and consequently set aside the
said land acquisition proceedings and pass such other
order or orders as this Hon’ble Court may deem fit and
proper in the circumstances of the case.”
