1. This writ petition assails order dated 17 December 2025 passed
by the Central Administrative Tribunal1 in OA 1717/2021.
2. There were five applicants in the OA, who are all respondents
in the present writ petition. The respondents claim that they have been
appointed on compassionate grounds as Multi-Tasking Staff2 in the
office of the Sports Authority of India3, albeit on contract basis, as
they were legal heirs of erstwhile employees of the SAI who died in

harness and were in financial distress. They contended that the
appointment had been made in accordance with the instructions on
compassionate appointment issued by the Department of Personnel
and Training4 on 16 January 2013, which permitted 5% of the
vacancies in any Group C post to be filled up by way of
compassionate appointment. It was in fact contended by the
respondents before the Tribunal that there was no reason to appoint
them on contract and that they ought to have been appointed regularly
at the very inception but that, as they were in financial distress, they
had no option but to accept the offer of appointment as was extended
to them.
