“20. It is well-settled that delay in lodging
FIR cannot be a ground to doubt the
claimant’s case. Knowing the Indian
conditions as they are, we cannot expect a
common man to first rush to the Police
Station immediately after an accident.
Human nature and family responsibilities
occupy the mind of kith and kin to such an
extent that they give more importance to get
the victim treated rather than to rush to the
Police Station. Under such circumstances,
they are not expected to act mechanically
with promptitude in lodging the FIR with the
Police. Delay in lodging the FIR thus, cannot
be the ground to deny justice to the victim.
In cases of delay, the courts are required to
examine the evidence with a closer scrutiny
and in doing so; the contents of the FIR
should also be scrutinized more carefully. If
court finds that there is no indication of
fabrication or it has not been concocted or
engineered to implicate innocent persons
then, even if there is a delay in lodging the
FIR, the claim case cannot be dismissed
merely on that ground.
21. The purpose of lodging the FIR in such
type of cases is primarily to intimate the
police to initiate investigation of criminal
offences. Lodging of FIR certainly proves
factum of accident so that the victim is able
to lodge a case for compensation but delay
in doing so cannot be the main ground for
rejecting the claim petition. In other words,
although lodging of FIR is vital in deciding
motor accident claim cases, delay in lodging
the same should not be treated as fatal for
such proceedings, if claimant has been able
to demonstrate satisfactory and cogent
reasons for it. There could be variety of
reasons in genuine cases for delayed

lodgment of FIR. Unless kith and kin of the
victim are able to regain a certain level of
tranquility of mind and are composed to
lodge it, even if, there is delay, the same
deserves to be condoned. In such
circumstances, the authenticity of the FIR
assumes much more significance than delay
in lodging thereof supported by cogent
reasons.”

this Court in Sunita (Supra) and Kusum Lata
(Supra), strict rules of evidence as applicable in
a criminal trial, are not applicable in motor
accident compensation cases, i.e., to say, “the
standard of proof to be borne in mind must be of
preponderance of probability and not the strict
standard of proof beyond all reasonable doubt
which is followed in criminal cases”.
20. In view of the above, we do not agree with
the view taken by the High Court while rejecting
the salary certificate (Exhibit 19) and pay slip
(Exhibit 20) of the deceased merely on the
ground that the person issuing the two
aforementioned documents was not examined
before the Learned Tribunal. The said documents
are conclusive proof of the income of the
deceased and were also corroborated by the
statements of the deceased’s wife (Appellant No.
1 herein) and his co-workers. As such, the High
Court was not justified in assessing the income
of the deceased at Rs.4,836/- per month on the
basis of minimum wages fixed by the State at
the relevant time. Resultantly, we affirm the
findings of the Learned Tribunal so far as they
relate to assessing the deceased’s income at
Rs.11,225/- per month on the basis of
aforementioned two documents. Annual income
of the deceased, therefore, amounts to,
Rs.11,225/- x 12 = Rs.1,34,700/-.”

“9. The Tribunal, by recording a finding that the
deceased was in the age group of 40 to 50
years, applied the multiplier of 13 while
calculating the compensation. The High Court,
curiously while maintaining the multiplier of 13
as per the judgment of this Court in
compensation only on the ground that the
deceased was aged 50 years 3 months on the
date of the accident, as such the compensation
is to be calculated on account of loss of
dependency by granting future prospects at 15%
but not 30%. So far as the application of
multiplier of 13 by the Tribunal is concerned, the
High Court has not interfered with the same.
When the age of the deceased was considered in
the group of 40 to 50 years, we are of the view
that the High Court has committed error in
granting only 15% towards future prospects
instead of 30%. As per the judgments of this
Court, primarily the age group is to be
considered. Considering the age group as 40 to
50 years, when the multiplier of 13 is
maintained by the High Court, there is no reason
or justification for reducing the compensation by
granting 15% towards future prospects. Though
the learned counsel appearing for Respondent 1
Insurance Company has submitted that the
compensation towards future prospects was
awarded as per the Constitution Bench judgment
of this Court in National Insurance Co. Ltd. v.
Pranay Sethi3 but at the same time it is to be
noticed that in the very same judgment in para

prospects, this Court has specifically said that
the addition should be 30% if the age of the
deceased was in the age group of 40 to 50
years. For application of multiplier, the High
Court has also accepted the age group of the
deceased between 40 and 50 years. In that view
of the matter, there is no reason for reducing the
compensation by granting future prospects at
15% only.”
