SKV Law Offices Successfully Secures Relief for SPRNG Before the Telangana Electricity Regulatory Commission in DSM Time-Drift Dispute

SKV Law Offices successfully represented M/s Sprng Transform Sun Energy Private Limited (“SPRNG”) before the Telangana Electricity Regulatory Commission in a petition challenging deviation charges levied on its 100 MW solar project in Mahbubnagar, Telangana.
The dispute arose from a 15-hour time drift in the project’s energy meters, which resulted in incorrect recording of actual power injection and inflated DSM charges for the period from 01.04.2023 to 16.04.2023. SKV Law Offices appeared on behalf of SPRNG seeking correction of the meter data, revision of the DSM invoice, and adjustment of excess amounts recovered by Telangana State Load Despatch Centre (TGSLDC).
The matter involved complex regulatory and technical issues concerning the implementation of the Telangana DSM Regulations, 2018 and the treatment of meter time-drift errors impacting deviation settlements across multiple renewable energy generators. SKV Law Offices devised and led a comprehensive regulatory strategy demonstrating that the anomaly was a technical metering defect beyond the generator’s control and that the DSM framework could not operate on factually incorrect data. By relying on industry practices, persuasive regulatory precedents, and the Commission’s powers to address implementation gaps under the DSM Regulations, SKV Law Offices successfully persuaded the Commission to direct correction of the time-drift error and establish a transparent methodology for recalculation of DSM charges.
The Telangana Electricity Regulatory Commission allowed the petition and held that the DSM charges raised through the impugned invoice were unsustainable to the extent they were based on incorrect meter data affected by time error. Importantly, the Commission directed TGSLDC to formulate and implement a uniform methodology for correction of time-drift issues affecting all renewable energy generators across Telangana and to issue revised billing and adjustment statements after regulatory approval.
The ruling is significant as the relief granted by the TGERC is not confined to SPRNG alone and extends to all similarly affected renewable energy projects in Telangana facing comparable DSM time-drift issues. The order therefore establishes an important sector-wide regulatory framework ensuring that DSM settlements reflect actual physical generation rather than distorted meter recordings.
