HIGH COURT OF MEGHALAYA
AT SHILLONG
Crl. Petn. No. 52 of 2024 Date of Order: 08.05.2026
____________________________________________________________
Shri. Jhonry Chyne &Anr. Vs. State of Meghalaya & Anr.
Coram:
Hon'ble Mr. Justice B. Bhattacharjee, Judge
Appearance:
For the Petitioner/Appellant(s) : Mr. K.V.E. Kharnongbak, Adv.
For the Respondent(s) : Mr. R. Gurung, GA. &
Mrs. P. Bhattacharjee, GA.
Learned counsel for the petitioners submits that the petitioner No.2
has filed an affidavit expressing her no objection to the quashing of
Criminal Petition No. 52 of 2024.
Mr. R. Gurung, learned GA appearing for the State-respondent
submits that though it is stated in the affidavit of the petitioner No.2 that
the petitioners have a daughter born out of their marital relationship, a
wrong birth certificate has been annexed as Annexure 1 to the said affidavit
in support of such assertion.
Faced with the above situation, the learned counsel for the petitioners
prays for grant of some time to correct the discrepancy and to replace the
wrong certificate appearing at Annexure 1 with the correct one.
In view of the above, 2 (two) weeks’ time is granted to enable the
learned counsel for the petitioners to take steps for necessary correction.
It is further submitted by the learned counsel for the petitioners that
the Special (POCSO) case No.2 of 2020 is fixed on 11.05.2026 for
recording the statement of the petitioner No.1/accused under section 313
Cr.PC. As the trial in the above case is almost nearing conclusion, he prays
that further proceeding of the Special (POCSO) Case No. 2 of 2020 be
suspended till final disposal of this Criminal Petition.
The learned GA appearing for the State-respondent has no serious
objection to the prayer and leaves the matter to the discretion of the Court.
In view of the above, taking into consideration the facts and situation
of the present case, and that the further proceeding of the trial may render
the instant criminal petition infructuous, at this stage, it is deemed
appropriate to direct the suspension of further proceeding of the Special
(POCSO) Case No. 2 of 2020 pending before the learned Special Judge
(POCSO), Shillong until further order.
List after 2 (two) weeks.
