    MC(W.P.Crl) No.1 of 2026 in
    W.P.(Crl.) No.3 of 2026 Date of Order: 19.03.2026
Shri. Ismail Marak Vs. State of Meghalaya & anr

The learned counsel for the applicant submits that the very basis on
which the criminal proceeding has been initiated against the applicant
lacks legality as the Lokayukta had no jurisdiction over the applicant. He
also submits that the affairs of the Garo Hills Autonomous District
Council do not fall under the jurisdiction of the Meghalaya Lokayukta.
That apart, the learned counsel contends that the investigation of the
matter and filing of the charge-sheet was also in blatant violation of

Section 20 of the Meghalaya Lokayukta Act, 2014. It is also pointed out
that in the similar factual background of the present case, this Court by
order dated 04.11.2025 passed in MC(W.P.Crl) No.6 of 2025 and order
dated 29.12.2025 in MC(W.P.Crl) No.8 of 2025, has suspended the
proceedings of the connected criminal cases involved therein.

Ms. R. Colney, learned GA appearing for the State has no
objection to the prayer for interim relief.

In view of the above and as the legality and validity of the entire
criminal proceeding initiated against the applicant is under challenge, it is
deemed appropriate to suspend the further proceeding of the Special P.C.
Case No.1/2023 pending before the learned Special Judge, West Garo
Hills District, Tura till the returnable date.
