01. The petitioners have challenged Government Order No. 08-JK (Rev)

SPONSORED

of 2026 dated 30th of March, 2026 issued by respondent No.2 whereby claim of

the petitioners for their regularization in service has been rejected. Challenge as

also been thrown to Order No. 601 of DIVCOM-K dated 31st of March, 2026

whereby the petitioners have been disengaged from their services with immediate

effect.

02. Learned counsel appearing for the petitioners has submitted that, in

terms of the judgement of the Division Bench dated 22nd of October, 2024 passed

in WP (C ) No. 1812/2022, titled “UT of J&K & Ors Vs. Showkat Ahmad War

and Ors” the respondents were only directed to consider the claim of the

petitioners for their regularization and there was no direction for dis-engagement

of the petitioners from their services. It has been submitted that in body of the
consideration order, no reason with regard to the dis-engagement of the petitioners

have been assigned, but while forwarding a copy of Consideration Order to the

Divisional Commissioner, Kashmir, respondent No.2 has proceeded to issue a

direction that the petitioners be dis-engaged from their services which is beyond

the scope of the aforesaid judgement passed by the Division Bench of this Court.

03. Issue notice to the respondents subject to the petitioners taking

necessary steps for effecting service upon the respondents within a week’s time.

04. Be listed on 30th of May, 2026.

05. In the meanwhile, Order dated 31st of March, 2026 passed by the

Divisional Commissioner, Kashmir shall remain in abeyance and the petitioners

shall be allowed to perform their duties.
