The present appeal is preferred under Section 374 Cr.P.C. by the accused-appellants Shiv Mohan, Girish Chandra, Swani (died), Kallu (died), Jaggu (died) and Govardhan (died) to set aside the judgment and order dated 22.01.1984 passed by 4th Additional Sessions Judge, Fatehpur in Sessions Trial No.332 of 1983 under Sections 147, 148, 323, 324, 325 and 326 read with Section 149 IPC, Police Station- Hussainganj, District Fatehpur, whereby the appellant no.2 Girish Chandra and appellant no.3 Swani have been awarded two years rigorous imprisonment under Section 148 IPC and appellant no.1 Shiv Mohan, appellant no.4 Kallu, appellant no.5 Jaggu and appellant no.6 Govardhan have been awarded one year rigorous imprisonment under Section 147 IPC. Further, all the six appellant have been awarded one year rigorous imprisonment under Section 323/149 IPC, two years rigorous imprisonment under Section 325/149, two years rigorous imprisonment under Section 324/149 and seven years rigorous imprisonment under Section 326/149 IPC.
