    The Court: The petitioner has preferred the present application seeking

    modification of the order dated 14.07.2022 passed in EC No.213 of 2022, AP

    SPONSORED

    No.424 of 2022 [now renumbered as AP (COM) No. 268 of 2024] and AP No.477

    of 2022.

    Mr. Saha, learned senior counsel for the petitioner at the outset submits

    that the petitioner is only seeking for extension for the Bank Guarantee and is

    not seeking any modification of the order passed by this Court in EC No.213 of

    2022 dated 14.07.2022. This Court vide order dated 14.07.2022 had stayed

    the operation of the Arbitral Tribunal’s award dated 21.03.2022 subject to the

    petitioner furnishing a bank guarantee. Pursuant thereto, the petitioner had

    furnished the bank guarantee on 04.06.2025 which is expiring on 25.07.2026.

    By way of the present application, the petitioner is furnishing a fresh bank

    guarantee in place of the earlier bank guarantee. In view of the same, the

    petitioner prays for leave to furnish the renewed bank guarantee in compliance

    with the order passed by this Court dated 14.07.2022. The petitioner had

    secured the arbitral award dated 21.03.2022.

    Learned counsel for the respondent states that he has no objection to the

    renewal of the bank guarantee.

    In view of the above, this Court allows the petitioner to furnish a fresh

    bank guarantee in terms of the order dated 14.07.2022 within a period of three

    weeks. Subject to the petitioner furnishing the said bank guarantee within the

    stipulated time period, the award dated 21.03.2022 shall remain stayed.

    With the aforesaid directions, the present application stands disposed of.
