    3. An FIR No. 71/2024 came to be lodged on

    19.03.2024 under Sections 417, 419, 420, 465, 471,

    474 and 506 IPC, 1860 at Police Station Kotwali,

    District Gorakhpur, Uttar Pradesh, alleging

    cheating, impersonation and forgery in relation to
    Signature Not Verified

    opening of bank accounts and alleged illegal money

    transactions. Undisputedly, appellant was not

    named in the initial FIR registered and was

    implicated later on the basis of custodial

    interrogation of the co-accused. The prayer for

    grant of anticipatory bail came to be rejected by

    the Sessions Court and the High Court.

    4. We have heard the arguments of the learned

    counsels appearing for the parties. According to

    the prosecution the role attributed to the

    appellant is that he introduced the complainant to

    one-Sanjay Chaurasia who took bank account’s

    detail of the complainant for carrying out the

    illegal transactions. The said Sanjay Chaurasia

    was said to be running an illegal website named-

    Anna Reddy Online Gaming and through that illegal

    transaction has been carried out. On the ground

    the gravity of the offence will have a societal

    impact, the anticipatory bail has been rejected by

    the High Court.

    5. Undisputedly, it is on record that after

    completion of the investigation chargesheet has

    been filed and supplementary chargesheet has also

    been filed on 06.12.2024. The appellant has been

    implicated, as noticed hereinabove, on the basis

    of co-accused’s statement.

    6. In the light of these facts, we are of the

    considered view that custodial interrogation of

    the appellant would not be warranted, at least at

    this stage.

    7. Hence, we allow this appeal by setting aside

    the impugned order and order that appellant be

    released on anticipatory bail on such terms and

    conditions as Investigating Officer may deem fit

    to impose including the condition of directing the

    appellant to cooperate with further investigation,

    if any, and shall appear before the trial Court on

    all dates of hearing except when exempted for any

    specific reason.
